    I have filed the claim through Money Claim online and have had an acknowledgement of service back saying my bank intends to defend all of the claim the date is 1st May. I know they have 28 days to do something about it but if I hear nothing from them can I file for the whole claim on the 29th May? not totally certain how all this works hope someone can help :confused:

    If they've "acknowledged" the claim, this gets them another 14 days, on top of the 5 and the original 14.
    The acquisition of wealth is no longer the driving force in my life. :)
  • Went through Moneyclaim to take court action against Lloyds TSB bank.After14 days passed, as there was no response from the bank ,I went on the site again.It said I could now proceed with a judgement by default.However,this was on the 15th of May and today the bank have just responded.This is two days after the cut off of 14 days.I telephoned Moneyclaim to query what that meant and was told the bank was allowed to do this even though it was over the 14 days.They now have 28 days and as I already used the judgement link once on line I will not be able to use it again.Therefore after 28 days are up I can download the orm and do it by post.Which apparently takes longer.I am panicking now and was wondering is this right?All responses greatly received.Thanks

    Its not 14 days from the date of issue its 14 days after the claim is served which is 5 days after your date of issue..is this what you mean?

    Yes, your date calculations are OK. You also seem to be aware that just "acknowledging" gets them another 14 days on top (ie. to 04/06).

    I am exactly 1 week behind you with my claim against MINT and, from other threads, it seems that the deadline is midnight. Guess where I might be at 23:59:59 on 11/06?

    However, if you do get judgement by default, take a screen print - I know of a case, where a defence was received on the deadline day but not input until the next day, and they tried to reverse the judgement.

    I issued Clydesdale Financial services on MCOL on 30th April- served on the 5th May, now they have 14 days to aknowledge.

    As of yet they haven't aknowled (though I know they probably will today ) but if they dont, can I ask for Judgement- after midnight tonight, or after midnight tomorrow.

    Any clarification please.
