Timings for MCOL/court
Comments

Cross that bridge when you come to it, the banks' solicitors are quite good at getting the papers in at the last minute these days.
If you are lucky enough to get a JBD then if you claimed via MCOL just click the button. If you've gone through your local court you need to fill in a form (can't remember its name right now).Hamsters have no tact and diplomacy, nor do they want any.0 -

Did you get notification of when the calim was "served". I just started my'n and the 5 days is up, but my "status" just says "issued"
You get notification when the claim is issued. You do not get one when it is served. The claim is DEEMED served after 5 days and the 14 days start then. If the bank does not acknowledge, it will continue saying "issued" until you click the Judgement button, if you are that lucky. It is more likely that the bank will acknowledge at the last minute which will give them an additional 14 days.Reclaimed thanks to this site:

Hi
Im the same, they acknoledged the claim and stated that they indend to defend but on Monday the 28 days are up.
What now, do I wait to hear???
I spoke to HSBC solicitor on Thursday, he said I'd just have to wait, they are still dealing with claims from February!!!!!
Beginning to panic that the time they get round to me, the banks will have come up with a cunning plan to stop my claim.
Surely the timescales mean sumthing and that if i dont hear anything on Monday... I'm rich !!
Can someone explain what happens next before I chuck in the towel and forget the whole thing .......0 -
Why would you want to chuck in the towel, now that you are that close? If they haven't defended by the end of the 28 days you can order a judgement by default. The solicitor's workload really is their problem, if they can't manage to press that button before Monday, all the better for you. Which reminds me, I ought to check OH's claim against Lloyds - time's up on Monday too and it still says Acknowledged... Keep a close eye on moneyclaim, they might just get a Defence in at the last minute!Reclaimed thanks to this site:

Hi
Just tried the judgement button again but still no joy.
I don't understand the timing on this at all.
It's now 5 weeks and three days since starting moneyclaim online! which I would've thought would be ok to press 'judgement'! How long does anyone think I have to wait until I can?
I'll try calling MYCOL later during lunch - If I can get through!Light bulb moment April 07: [strike]£3,655 [/strike] Oct 07: [strike]£2,220[/strike] now 0 - 3 years of Uni debt to be added at a later datenow at Uni as a Mature student -update: now has a First Class BA!0 -

I am exactly 1 week behind you with my claim against MINT and, from other threads, it seems that the deadline is midnight. Guess where I might be at 23:59:59 on 11/06?
However, if you do get judgement by default, take a screen print - I know of a case, where a defence was received on the deadline day but not input until the next day, and they tried to reverse the judgement.
Ok so I have clicked for judgement but have got the response shown by someone else above, reiterating the times that should be allocated etc. Have I tried for judgement too early in the day? Should I try tomorrow which should be 15 days?
I have read Beate's timing post and am still unable to work out why it won't let me click for judgement so be grateful for advice.
Many many thanks

Probably because its a Monday and if you check the FAQ on MoneyClaim you'll find they are given an extra day.0

Hi To All
Ok so ive followed Martins bank charges instructions and as i got no joy i submitted a claim with the online money claim courts.
I know my claim was accepted as i have checked on the money claim website, but now the 14 days are up today and ive had no response from the banks myself i have tried to issue a judgement as it states if the banks dont respond to you after the claim has been served (which is 14 days) you have won by default. But the online court wont let me do that.
What do i do now? Am i not right in thinking as the banks have not responded i have won or do they get 28 days to respond???
From a very confused member0 -
I just rang moneyclaim online and they have told me that I can press the judgement button after midnight tonight! Hoorah... Hope Monument don't get there before me!
Does anyone know what happens after? Ie monument do not respond and I press the judgement button... anyone got to that stage or pass this yet?
I'm guessing that I will be issued a court date next???? I HopeLight bulb moment April 07: [strike]£3,655 [/strike] Oct 07: [strike]£2,220[/strike] now 0 - 3 years of Uni debt to be added at a later datenow at Uni as a Mature student -update: now has a First Class BA!0
