    i recently posted a claim in the MCOL and its "started" i read that i need to wait 14 days (plus 5 days) to do something if the banks dont respond, but thats all i know, what im asking is what i need to do, do i write to my bank or something? i dont know anything.

    Yes, the defendant has 28 days from the date of service (if they have submitted an AoS). Most banks are putting them in right at the last minute, sometimes marginally over the 28 day limit and most courts are allowing it.

    Either way the default judgement button on the MCOL website will only work when you are entitled to click it.

  • I followed all the advice on reclaiming unfair charges.
    The bank offered 50%; I said I would settle for 80%, they declined.
    I registered a claim online with HMCS money claim online.
    After 14 days I requested judgement; that afternoon they registered an acknowledgement. The 28 days is up shortly, but if I go on-line there doesn't appear to be an option to request a judgement anymore.
    HMCS helpline is always engaged, does anyone know if I can request a judgment online after the 28 days are up? Or do I have to call to do this? Thanks, Kel.

    Just keep trying the phone. Always best to speak to someone, especially if you have any questions. You will get through eventually. I don't know if ringback on your phone would work with their telephone number 'press 5'.

    I have recently taken Barclays to court for charges amounting to £2000. The claim was deemed to be served on May 14th and in the letter I received from the court I was told that they have until 28th May to reply. Barclays have made no reply or acknowledgement, but I have not been able to request judgement by default. Is this because they still have the rest of today to reply?
    Should I stay up until midnight and request judgement immediately after midnight or should I wait until tomorrow morning?
    Any advice would be appreciated as I feel somewhat on the brink here!

    Are you forgetting that today is a bank holiday?

    No, although I was hoping that perhaps Barclays had.

    Can I not request judgement by default on a Bank Holiday as it is all online anyway?
