as thier last day to defend falls on a bank holiday the bank have until midnight tomorrow to enter a defence! you will not be able to request judgement until 12.01am Wednesday.

Hi, I have used this site to reclaim against Lloyds TSB for the sum of £1400 including interest. I went through the usual process of getting my statements, asking for my money back and getting refused and sending the letter threatening court action. I didnt get a reply from the last letter so I used MCOL and started the claim. On the day MCOL sent me the reciept I recieved a letter from my bank saying they was going to pay me a goodwill gesture of £750 which they paid into my account within 2 days. I wanted to carry on claiming the rest so I sent a letter to my bank saying I shall accept it as part payment.
My claim will have reached 14 days in the morning and was wondering what the next step is and how to go about it? Also should I of ammended the claim to the new amount after the £750 payment?
Any help would be very much appreciated.

Strictly speaking, you should have let the court know about the part settlement. However, the courts are well aware that the banks use these last minute offers and payments to try and trick unwary claimants into such procedural errors. Give the court service a ring.The acquisition of wealth is no longer the driving force in my life.0 -

You'll probably find the bank will enter a defence at the last minute and gain themselves a further 14 days, have a read of Beate's post in the Reclaim Help Thread.0 -
Update on my claim:
At 00.01 on 29th May I requested judgement by default which was accepted online. Is this it? How long do I have to wait before I receive a definite answer?
Also can anyone help? I want to read the full process on the success stories thread but each time I click on it my screen goes blank.0 -
Hello, I read Martin's advice about what to do when you file a claim, which I have done with my bank. See below:VICTORY. The bank does nothing. This is a very common outcome; often the bank simply doesn’t acknowledge the claim and this means you automatically win by default 14 days after the claim is served (which takes 5 days). At that point, you must request ‘judgment by default’, this can be done online, and you should do it as soon as possible (get it in your diary and plan around it to the second if possible) after the 14 days ends.
so far my claim status is: Issued(21/05/2007). At what date will I need to use the "Judgement by Default" I am confused because Martin says 14 days (plus 5 days for claim service) but does that mean i gotta wait 19 days from the 21st?

Does anyone know how long it takes to receive a court date?
22 May - I tried for judgement but Monument got there first! Their defence date was for 3 weeks prior to this... I guess they're just prolonging the joy! It's only been 5 days since MYCOL says it's now going through the courts.

:rolleyes: my 28 days after serving a claim on barclays is on a sunday , do i wait until monday or later to give them more time ?? or do i request a judgement straight away. never been on a forum before so i dont know where this will turn up sorry if goes to wrong place.0
