    28 days are up... can I press the judgement button yet... can I?... Please..... Pretty please wiv a cherry on top - and sprinkles???? :D :j

    I've read lots of forums about MYCOL but I'm still confused... :o

    I just want to know when to press THE button

  • Try it , go on you know you want to . The thing with MCOL is that if you're too early pressing the judgement button it will tell you and won't let you do it .
    So go ahead and press it and see what happens

    (Moneyclaim online apparently have a back log: do you think this is why nothing has happened???)

    I did get a Notice of Issue: (see ealier post) that said they were defending but do they have to contact mycol to confirm this or what.... I'm soooo confused!

  • Click the first option . I had a notice of issue saying that they were defending but until they actually enter a defence you can still claim judgement by default if they have not entered their defence within the timescales stated .Saying that they are defending and actually defending are 2 seperate things

    'You cannot request a Judgment by Default at this time.
    The Defendant is allowed 14 days from the date they were served with the claim to defend or admit your claim before you can request a Judgment by Default.
    If the Defendant files an Acknowledgement of Service within 14 days of receiving the claim form, they will be entitled to 28 days from the date they were served with the claim form to file a defence or admission of your claim. If the Defendent does not file a defence or admission within the 28 days you can request a Judgment by Default.
    If you have not requested judgment, the defendant may still file a defence to your claim after the 14 days or 28 days have elapsed. The claim will then be transferred to your local court for a hearing to be arranged.'

    but it says 28 days - it's now over 28 days since they were served with the claim form... I dont' understand this at all... how much longer do I have to wait before i can press for judgement... I first logged the claim on the 13th April - they acknowledged on the 19th April so I'm now 28 days from that date!! I was getting all excited too! - talk about anti-climax :o

  • ring Mcol up and ask what date you can apply judgement by default .They are very helpful and will tell you exactly when you can
  • If you filed on-line on the 13th April that was a friday so they probably posted the claim to your bank on the monday or tuesday (that being 16th or 17th . Service is deemed to be 5 days after this , so 21st or 22nd April .Then count the 28 days from then .So that comes to this weekend .Now because MCOL don't work at the weekend , ive got a feeling you will have to wait until midnight on this coming monday .Ring MCOL up and they will tell you exactly

  • Hi newbie here:D

    Im helping my brother reclaim his bank charges.To cut a long story short we lodged our claim in the small claims court, on the 13th day the bank acknowledged the claim(no defence).
    do we have to wait 28 days from now, or only 14 more days??, the claim was acknowledged on 11th May.
    JUst wanted to know so we are on the ball to lodge the judgement to the nearest second LOL.
