Hi I have now submitted my claim on the MCOL it now says issued on the 18/05/2007 the next box is the judgment which has a button in it called "start" when i press it i get two possible options one is defendant has not issued a defence (i dont expect this yet) the second is the defendant admits that all the money is owed
i suppose i need to wait a certain time before hitting any of the buttons inc the start one
please helpReceived £4541 reclaimed from Natwest :j:T0 -
Hello Denny,
Yes you have to wait just now as they are given 14 days to respond if not you can then carry on with the request ( it will only let you carry on once the timescale is up), If they do acknowledge your claim they are allowed a further 14 days ( or 28 in total from the date they served with the claim)

Give it 5 days from when you issued the claim which is how long the courts give the defendant to have been deemed as served.
The bank then has 14 days to Acknowledge of Service
If they do put in an AoS then they have 28 days from the date they were deemed as served to submit a defence.
If they don't meet any of those deadlines then you can click your Start buttonHamsters have no tact and diplomacy, nor do they want any.0 -
Hello folks,
Yesterday I requested judgement by default as Lloyds time was up, and today my judgement request has been accepted and has been issued.
My questions are
1. Is it now possible for Lloyds to defend as I have read a couple of posts that some banks have entered a late defence ( a few days late) and been allowed to carry on, or is this just because judgement has not been requested.
2. Also a simple one but what happens now? Will lloyds now just send me my money?
Thanks in advance,

Oh if only it were so simple.
Give it until Tuesday or Wednesday before you get your hopes up to much.
If indeed they don't get their papers in by then, then they have 14 days in which to comply with the judgement. If they don't then get a warrant and send in the bailiffs.Hamsters have no tact and diplomacy, nor do they want any.0 -
Thanks Kurt_Hamster for your super-quick reply, I had a feeling that that might be the case but I suppose I am still a step closer :beer:Lloyds TSB - £1979 thank you

Hi. I've started my court claim against Halifax online.
My status is saying my claim has been "Issued" does that mean its been "Served". Its been more than 5 days since I put in the claim and I don't know if I should start counting the 14 days till Judgment day.
And is that 5 working days? Or just 5 days?0 -
Can anyone tell me where to find the letter to send for judgement default if I dont hear after 14 days. I have started court proceedings and the fourteen days is up on tuesday next week. Does that mean I win by default.?
Hope you can help

Yeah I think it does, you just go onto the court website and declare it online as soon as the 14days is up!
Did you get notification of when the calim was "served". I just started my'n and the 5 days is up, but my "status" just says "issued"0
