    My claim against barclays was issued on the 25th april (according to the claims menu online). It is now 14th, which is 5 days after it was issued plus 14 days. Can i make a judgment now or do i have to wait to the end of the day? Cheers

    I'm on the stage where my claim has been issued against Abbey (i filed my claim just after i send my 4th letter, i knew they'd reject my offer syaing their charges were lawful even before it came) anyway my claim was issued on 11/05/07 i have heard you have to wait five days for the claim to be deemed served and then fourteen days for the bank to reply. I just want to know does the fourteen days apply within the five days or do i wait for it to reach the 16/05/07 and then wait 14 days? I have read the reclaim 'your bank charges help thread' but i still don't know.

    It should give you a "timetable" with dates on your Notice of Issue (it did on mine).

    The defendant gets the five days (until 16/05) for the claim to have been deemed to have been served. They then have another 14 days (until 30/05) to respond. However, if they just "acknowledge" the claim, this gets them another 14 days (until 13/06), even if they actually "acknowledged" within the 5 day period.

    The wheels of justice grind slow, but they grind exceeding small.

    I am on the 14th day after leaving 5 days after my claim was issued. I am ok to start the judgment? I don't have to give them a full 14 days or something? Sorry for being a pest. Thanks
  • Dear all, hope you can help.I have filed a claim against NatWest with Moneyclaim online. The claim was issued on 01/05/2007, the guide in this webside states you automatically win by default 14 days after the claim is served (which takes 5 days). Does this mean I could ask the judge to make a ruling on 15/05/07 or do i have to wait till 20/05/07? Im very confused!!! please help. Regards Richard

    I havent used MCOL myself ( went direct to court) But have read on here that its 5 days + 14 days as time is allowed for them to recieve it, then you have to apply for judgement by default on MCOL.

    In the reclaim help thread it gives all the timings for MCOL.

    Try the "Judgement" button/link on the MCOL claim. Cue Sylvester Stallone/Judge Dredd impression - "Prepare to be judged!"

    From the date issued (01/05), your claim was deemed to have been served after 5 days (06/05). They then have 14 days to respond (20/05). However, if they just "acknowledge" the claim, this gets them another 14 days (03/06), and this is even if they acknowledged by return of post within the 5 days.

    Im a bit unsure whats happening here. 2 weeks ago the money claim online site said Barclays have 2 weeks from the date I submitted the claim to respond. I checked the site today (deadline for the 2 weeks) and it says aknowledged, the bank now has 28 days in which to either pay the money or take it to court. I presumed 14 days was the limit, now im finding its 28 days.

    Anyone else had the same thing? Did barclays go to court or pay up?
