HI , i have started court proceedings against Nationwide bank for charges. They acknowledged the claim on 14/06/07 , do they have 28 days to respond to MCOL & can i then just check the make judgement button.
When are the 28 days up , does it include weekends etc or just Mon - Fri.
What will happen next???:eek: :beer:

I know this forum has a long list of posts so for anyone that has reached the 28 day deadline please be aware that MCOL gives the banks 5 days extra to lodge their defence. This is to allow for postal delays and their own admin to catch up.
If the 33rd day (28+5) falls on a weekend or bank holiday they are given till the end of the next working day.
A bank may submit a notice to defend which means their paperwork will follow within the next week or so. Once MCOL have the defence they will forward it on to you and a local court. You then need to wait for further instructions from your court as to what to do next.
I currently have 3 claims at 3 different local courts.
The first sent me an Allocation Questionnaire and I now have a Hearing date. The bank is worried now and upped their offer to, and I quote from the letter here, avoid the risk of litigation.
The other 2 courts have gone straight to Direction Hearings
This has avoided the additional cost on 1 claim (£100 due with Allocation Questionnaire if claim over £1,500)
The other court requested this hearing should be via a telephone conference to make sure the bank 'attend'.

My dates are the same and I have just gone to start judgement and it said I am not able to issue at this time and is showing as continue.........what do I do now

Have they acknowledged the claim? If so, they have an extra 14 days.
If not, try daily, and consider contacting MCOL.0 -
I can enter judgement on the 14th but at what time? I need to know because I'm going away on the weekend. Is it at midnight on the 13th or midnight on the 14th?0

You need to give them the full 14 days, and if the 14th day falls on the weekend or bank holiday, the bank gets an extra's day grace. Read about timings on MCOL in my post (no.13) on the Reclaim Bank Charges Help Thread (sticky on top of the board).Reclaimed thanks to this site:

Hi all,
I am just after a bit of clarification from you guys please.
I sent all the necessary letters etc to claim back my bank charges but they were declined by my bank so I started a claim through moneyclaim to try & get the cash back.
I started my claim on the 20th June. According to the Moneyclaim site Nationwide acknowledged the claim on the 26th June.
Am I correct in thinking that Nationwide have 28 days to either pay or defend the claim from the date I started it (20th June).
If so it will mean by Wednesday this week something should have happened.
Is that right??

if you issued your claim on 20th june it is deemed to be served by 25th june you count 28 days from then...in other words they have till 9th july to acknowledge then 23rd july to defend..
