They do allow leeway of a day and more if the "judgement" day falls at the weekend or a bank holiday.

Your case will now be transferred from Northampton (the court nearest to MCOL) to your local court and all correspondence will now be dealt with through them.

edited to add I just noticed your post said the bank had acknowledged, they now need to submit a defence. Read Beate's post in the Reclaim Help Thread which is linked in my signature regarding the timings of MCOL.
  • Ok I've got home tonight and received the letter from MCOL stating that Barclays have filed the acknowledgement.

This is definately more clear as to why the MCOL status was showing rejected as it appears Barclays got in the last minute to file the acknowledgment wish is madness in my opinion but I think because the date fell on a weekend they were granted an extra day wish is why they have been able to do this!

On the letter / acknowledgment that Barclays have filed it states they wish to defend the whole claim. Is this likely ? and if they do defend I'm guessing i'll have to go to court.
Do I have any chance of winning and if there any advice of what i should do if things get to this stage ?

    Cheers

    Hope you can help.

I went through MCOL. My claim was issued on 4th June and deemed served on 9th June. Lloyds had until 23rd June to defend. They defended on 11th June. I have had no other paper work since then! No transfer of proceedings notification or anything!

I have phoned MCOL this morning as I was really annoyed that I hadn't received anything whilst my partner's claim had been settled (not paid yet thou). The said they would get a manager to look into it and I have to ring back next Friday to find out what stage my claim is at.

Maybe I should have phoned earlier. Do you think if I ring SCAM they may have an offer for me or should I wait and rinf MCOL back next week?

    Thanks

As your "date" falls on a weekend the bank have until Monday to acknowledge or enter a defence whichever stage you are at.

I have just made a claim on MCOL against the Woolwich but am unsure of the timescales from here.

I assume the 5 days to serve the claim starts on Monday (23rd) and ends on Friday (27th) of next week. Is it then 14 days from the Friday they have to respond (making their deadline to pay up 10th August)?

So assuming I dont hear anything (fingers crossed although the way my luck is at the minute I doubt it!) do I request judgement by default on the 10th or 11th?

I wouldnt mind its only for £303 which compared to some is peanuts - but I think the Woolwich is one of the hardest to deal with.

    Thanks in advance

Hi, i put a claim in 5th july, it was issued on the 10th and they have till the 24th to reply, you should get a letter from the court (mine was a couple of days after i logged it on moneyclaim website) telling you the exact dates that things are issued etc. Its 14 days inclusive of weekends from the issue date not the submitted date.Hope this helps and good luck.

No problem, if we all stick together and pass on to others what we have learnt it makes it alot easier.

Read Beate's post in the Reclaim Help Thread regarding the timings for this and do remember if the date falls on a w/end or bank holiday they are allowed a further day.
