    It's 28 calendar days.

    If they decide not submit a defence then you will be able to request judgement by default after the 28 day period is over.

    Hi, on friday I proceeded with claiming my bank charges back by going to the moneyclaim website and entering my details on there. I have gone to the site today to check it has gone through and the claim is there as expected, but under the judgement header it says 'start'. If I click on this it gives me an option of entering judgement by default or by admission. Do I need to select one of these options or am I jumping the gun a little bit. Help greatly appreciated.

  • I have had court letter sent to bank and had a reply back to say that they had until 7/7/07 to reply. I understood that if they did not reply withtin this period I had won by default. However the online moneyclaim will not allow me to claim by default and now say that they have 28 days to reply. Any advice on this please

    Hi,
    First time poster long time viewer, so i hope someone can help, am at the mcol process against halif,
    got the letter from the court saying claim was issued on the 19th june 2007 and it will be deemed served on the 24th june 2007 the defendant has until the 8th julyy 2007 to reply, checked mcol site tonight and it is just saying issued and no refrence to the bank having put in a defence,can i click on judgement by default as ive heard nothging or do i have to wait longer, can someone please advise.

    Looks like the bank has acknowledged the claim. Read up about timings on MCOL in my post in the Reclaim Bank Charges Help Thread (sticky at top of the board). It's post 13.

    HI , i have started court proceedings against Nationwide bank for charges. They acknowledged the claim on 14/06/07 , do they have 28 days to respond to MCOL & can i then just check the make judgement button.
    When are the 28 days up , does it include weekends etc or just Mon - Fri.

    What will happen next???:eek: :beer:
