    Hi all,

    I'm in a bit of a panic, and just wondering if you can clear something for me please?

    I have gone through the MCOl procedure to get my charges back from LloydsTSB, and I can't rememebr ever seeing at any point in on the MCOl site, where to state your local County Court??

    As I have noe gone through the process, i now see that the clain form has the Northampton county court listed on it. This is not my local county court.

    Any ideas anyone?

    This is nothing to panic about. NOrthampton is the default court and will revert to your local court once a defence has been entered.

    Money Claim Online should have issued your claim either on the same day, or the day after, you filed it. They then allow 5 days for it to be served. The bank’s solicitors then have 14 days to respond. However, their response can be just filing an Acknowledgement of Service. If they do this, the 14 days is increased to 28 days. If the deadline expires on a weekend or Bank Holiday, they get the Monday or Tuesday respectively.<O:p</O:p
    The acquisition of wealth is no longer the driving force in my life. :)

    Do you know the answer to my msg above the one you just answered?

    Also on this Notice Of Acknowlegment Form it says at the bottom:

    1: I intend to defend all of this claim with a x sign in the box

    2: I intend to defend part of this claim with nothing in the box

    3: I intend to contest jurisdiction with nothing in the box.

    What does this mean?

    They have 28 days from when it is deemed served regardless from when it is really served and/or acknowledged, so it is 28 days from 1 July.

    It means the bank has ticked the box that they intend to defend the whole claim. It doesn't mean they will but I think they tick this routinely. Stop worrying.

    The Halifax were due to respond to my online claim that I made via HMCS...but as of today...they have not even acknowledged, let alone filed a defence at all... The claim is still reporting 'Start'

    Shall i wait until Monday Morning, and then file a default??

    From what i have been reading elswhere, they should offer you the full amount around July 20th. Fingers crossed.

  • Hi everyone,

    I'm at the stage that I've issued a claim against Barclays through Moneyclaim. I received a 'Notice that Acknowledgement of service has been filed' (on 13th June) through the post and stating that the defendant (Barclays) now has 28 days from the date of service to file a defence.

    1st question: Is that 28 working days, or 28 calender days?

    2nd question: If, once that period is up, Barclays decide not to do anything (it's only a couple hundred quid), what is the procedure for me?
