    Hi
    We have submitted our claim online. We are now at the stage where the banks 14 days to acknowledge the claim has elapsed (Saturday). Can anyone please tell us what the next stage is? On our claim site it states our claim has been issued and that is it. We recieved a letter from Northampton County Court stating the bank had until the 21st July to reply but this hasn't happened as far as we can see.
    If the bank had acknowledged our claim would this show on our money claim page?

    If the bank has not acknowledged our claim within the 14 days and the 14th day lands on a weekend can we use MCOL to issue judgement? The 14 days were up on Saturday, the letter we had from the court confirms this but we have been unable to issue the judgment it keeps telling us that the judgment is not allowed at this stage.

  • I am just filling in form, and am basing my 'Particulars of Claim' from Post 6 by Rex Mundi from the MCOL thread.

    it says ' the claimant has an account [account number] with the Defendant, opened [put date opened]. [I have found out the date the account was opened from my bank].

    It then says 'Since [Date] the Defendant debited charges and interest in respect of purported breacheds of contract etc......

    Can anyone tell me do I put the date the account was opened here which was May 2000 or do I put the date I am claiming from which is November 2000?

    At this point I'm stuck, I Don't know what to do, please help

    I am new to this site and need a little help with making my court claim against the Abbey.
    Am prob being abit blonde but have started my claim online and it has been accecpted and issued but I need to now select and enter a jugdement- do I click the "by DEFAULT" or "by ADMISSION" box??? or do I now have to wait 14 days for a response from the Abbey BEFORE doing the above!!!! confused !

  • Thanx for repling - so do I have to leave this section the 14 days before clicking either box? i.e the Abbey have time to respond ?
  • Hi Carter_s1469, you will have to wait the 14 days, you wont be able to do it before, as the system wouldnt allow it before then, and you will get a message saying so. If the judgement days ends on a weekend day, you wont be able to do anything until the next working day, as I tried. My judgement with Nationwide ended on a Sunday, and I was straight in there at midnight, and got the not allowed message.
    So suck it and see, you cant go wrong
  • Hi all, me again. I have been sucessful in reclaiming my bank charges from the Nationwide building society. My question is about the interest. As I won my claim by default, the Nationwide has to pay the interest at 8%, I had in fact added the interest to the claim, using Martins calculator, which came out at £1984, Nationwide has paid interest of £1060.38, which calculation is right? Can anyone please help?

    Well I'm still waiting in a sort of limbo at the moment.

    I entered my judgement last week after the 14 days had elapsed and Barclays put a claim in at the last minute it seems and now I've had a letter from MCOL saying they have rejected my claim, i can do nothing further and that's it!

    From what I've read if Barclays have acknowledged the claim then surely they get another 14 days but shouldn't the claim status on MCOL change again to allow me to resubmit a judgement if barclays don't defend at the end of this extended 14 days. I've checked MCOL and the status still says rejected a week later?.

    The form attached to letter from MCOL had the Acknowledgement from Barclays stating they are going to defend the full claim does this mean it's out of MCOL hands and will be sorted out with a local court?

    I'm confused!
