I claimed 1200+ from halifax plc but they eventualy offered me £504 which i declined. i had already started a court claim , they failed to acknowledge the claim so i asked for the court to enter judgement, the court has rejected my claim today and says no further action can be made online is there anything else i can do0

Hi all, Barclays had untill Monday 30th to put in defence, they didnt, so i asked for a judgement via the money claim website, and it has come back 'rejected'.
Sowhat does this mean.
Its getting a bit confusing with this test case, dont undetstand how the court is affected by this case,
help is appreciated!0 -
It may be the case that the bank has filed a defence and that your copy is on its way to you check with the court to see if they have recieved a defenceAs I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0

Late last night I submitted my claim for bank charges via MoneyClaim.
This morning when I logged into the system a new page had been added giving me the option to 'enter judgement by default or admission'.
I am very confused by this as I thought it took about 5 days to serve the bank with the claim, and a further 14 on top of that before I can enter a judgement (and then only if they don't respond to the claim). Does anyone know why this part of the claims process has appeared online already? Should I ignore it for now and wait the statutory 19 days, or should I file for judgement now - it's very confusing!

You won't be able to press the judgement button until the due time has passed.
If it comes back saying rejected this means the bank have entered a defence and you will hear from MCOL to say your claim has been passed to your local court.
MCOL generally allow an extra day for this and an extra day at the w/end or bank holidays, please read Beate's post in the Reclaim Help Thread which is linked in my signature.0 -
Thanks Edinburghlass - it does look as though it's 'live' already though, as there are boxes I can tick. Do I assume if I tried to proceed any further than the box-ticking for judgement or admission I'd eventually be blocked - I'm really loathe to touch anything to find out in case I mess it up!!0

Hi there - yes this confused me a bit too...!
Basically, the 'Start Judgement' link is always clickable, but when you click it you go to another screen where you can select 'Judgement by default' or 'Judgement by admission', and only then do you click the 'Continue' button which actions your request.
If you request 'Judgement by default' when the time for the defendant to reply has not yet expired, then you'll see a message telling you to wait longer and try again. So you can't do any harm - try it yourself.
I'm at this stage myself right now against NatWest and they apparently haven't entered a defence yet. In fact their 28 days ran out yesterday (Saturday 4th), but I guess because it's the weekend the MCOL site isn't letting me request Judgement by default yet. Hopefully I can make the request on Monday and it'll be accepted and then I'll get my £2,000 back. Though since all the recent stuff about the test case I'm feeling less hopeful...
