You should have recieved a letter giving the date it was served.

Nope, just the issue letter and the letter with the acknowlodgement attached which says the 21st Aug on it.
  • I applied to MCOS to claim my bank charges back. The bank acknowledged within 14 days. I understand that then gives them another 28 days to file a defence. The acknowledgment was dated 10th Sept and I received a letter saying they would apply for a stay but MCOS shows nothing more and I make it that their time is almost up.
If nothing changes can I then apply for judgment by default or have they done all they need to?
    Thanks.

You won't be allowed to tick the judgement box until the correct time and if this falls over a weekend the bank will be allowed an extra day to enter a defence.

If they do enter a defence then its likely that MCOL will automatically apply a stay on your case.

  • Just a quick question, but just want a bit of advice/re-assurance...

Going through an m-col against Barclaycard, it showed up (ONLINE) as "defence" on the 11th SEPTEMBER....but i have recieved nothing from the courts apart from the standard letter that the claim has been acknowledged.

Is this correct? and if so, what should i be expecting and when?......

Thanks in advance for any help.

    Hi Vicky,

I think Im right behind you because I should be able to apply for 'judgement by default' tomorrow assuming the bank dont put in their defence today so Id be interested to hear how yours goes.
I assume yours is for bank charges not credit card?

    Thanks
