I wrote to Halifax for my wife on 18th March to get the information on charges from her plan with IF.
We got a letter back last week stating because we did not provide an account number or roll number they can not trace the account to provide the information , even though we supplied my wifes full name, address for last 6 years and date of birth. The account was closed 2 years ago.
Can they do this or do i have to go through a court/ICO to get the info?
Any help is greatfully recevied.Chris

Yes. You can claim on old closed accounts. You can claim back 6 years from today.

natweststaffmember wrote: »Navidson, the answer is yes, and boy have they made a mistake in doing that. Try sending a Subject Access Request. If they fail to provide the details or fob you off then I will tell you how you can tell them to get it. It is 100% successful. I am an expert on getting the numbers and it appears your account was open prior to 2002, so even better, i am rubbing my hands in glee.
I have requested details from closed accounts from RBS and Nat west Credit cards. Nat west Visa only closed last year I sent name ,address , do birth type of card Nothing has changed in 20 years
I know they are the same firm now My letters were sent tothe correct ,different places I recieved in the post identical worded letter re 'cannot trace this account - have I got the right cards ?
I found the RBS acount number and the Nat west card is a Visa as I had said and only closed last year
Is this a fob off and delay??
Any suggestions of what else to write to Nat west?0 -
Hi all my other half has just started proceeding to reclaim her charges and it has started me thinking.
Can I claim back charges for accounts that are now closed??? If so is there a way of finding out my old account details from the bank as I have destroyed everything I had in my possession.
Thanks in anticipation of any help or advice offered

Write to the banks concerned sending a Subject Access Request and enclosing the £10 statutory fee as per usual giving your full name and address including any previous ones and your date of birth. The dates the accounts were opened/closed is useful too. They may claim that older material is archived and that they are unable to trace you so pre-empt this by stating in your initial letter that archived or microfiched data is relevant to the Data Protection Act and as such you are entitled to have that searched too.
Alternatively this site run by the Bristish Bankers Association offers a free service to trace old or dormant accounts and you may wish to give it a go :

A few years back, I had an account with Natwest. I had a lot of charges put on the account. Natwest (for some unknown) closed my account.
I was wondering how I can get my bank statements?
Do I have a legal right? If so, what is the timescale they need to provide them?
I phoned them the other day and they said I need to go in branch, which I did. They then said I need to write in. I just need to know my rights so when I write the letter, I know what to say.
Thank you.0 -

You need to make a Subject Access Request under the Data Protection Act, as described in Martin’s article.
The addresses are in the Reclaim Bank Charges Help thread.
If you still have the account number, this will help the search a lot.
Old records are sometimes held on microfiche, so use the paragraph reminding the bank that these are also covered by the DPA.
You can claim 6 years from today. However, today moves. For the Subject Access Request, it is 6 years from the date of your request. For the bank claim and the Financial Ombudsman, it is 6 years from the date of your first claim letter. For a court claim, the Limitations Act 1980 states that it is 6 years from the date your court claim is issued.
If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, you can refer the matter to the Information Commissioner.
However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s. The banks and credit card companies have received so many "black marks", that one more doesn't make any difference.
In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, all you have to do is fill in the blanks. The acquisition of wealth is no longer the driving force in my life.0 -
I had an account with natwest from 1999-2003, and had to close it cos of the charges i was incurring.
I requested statements (you can go back to 2001) sent off the £5 cheque that Natwest charge for the info. You are entitled to this information and i recieved the statements. sent off letter after totaling charges (£1462) AND THE HAVE JUST OFFERED ME THE LOT! Hopefully your claim will be as easy as mine!Reclaimed Charges £2433
