Even tho it has never been their home and she has never contributed to any bills?

Why do you say it has never been their home?

I'm very surprised that the existence of the child has only now been mentioned, as the child's well-being and home is surely the most important part of this discussion.

    Is the child his?
  • Bit of legal advise taken he can serve her with a notice to quit...if she refuses then eviction proceedings can be lawfully commenced.. Thank you for all your input..xx
  • Yes the Child is his..he has parental responsibility...The Childs home was never there as i said they lived elsewhere. He will continue to take responsibility for the Child...but its like she had this intention from the beginning when she moved in..to get in there then change the locks but continue to think that my Son has to keep a roof over her head...

Will your son have the baby living with himself in his house? If not, does the girlfriend have somewhere else suitable for her and the baby to live? I hope he isn't planning to make his own baby homeless...

The Child will never be made homeless...Her Father owns numerous property's plus she could always return to her parents they have 2 spare rooms..there are numerous options for places for her to live...have a feeling though she thinks its her right to stay where she is.. let My Son continue to pay and lock him out of his house... if he serves her with a notice to quit and she stays put then he has no option but to start eviction proceedings..that way she will have to be rehoused by the localauthority.. Hate to say it but i think the child in her eyes is a meal ticket...She is doing nothing in the best intrests of the Child.

He can use any means necessary to get into his own house and move back in and there is nothing she can do about it. If the police turn up she has to prove her right to live there.. she has none it is not her house! He can prove ownership so nothing will be done.

I could not change the locks on my house because my XH's name was on the mortgage and he could quite legally break in.

If he has numerous properties is it such a terrible idea that his child and the child's mother live in one? How would the rent compare to the 20% of his income he'll need to give her for maintenance?

(Hang on, the child's father has properties or the mother's father? I'm getting confused now!)
  • Confusing but its the Mothers Father who owns several property's..oh and re maintenance he will only have to support the Child..they never Married..
