I'm sure she's going to get all kinds of squatters rights now and could make things very difficult.

Still, nothing to stop your son breaking in to *his* house and taking a poop on *his* pillow now and again ;)

I don't have much serious to add on the subject, but thought I'd bump anyway, in case someone has better advice...

If the house is in his name then she actually has no legal right or recourse to lock him out.

He'd be advised to contact the police / turn up with them in case she kicks off and starts accusing him of anything.
He'd need details showing he has the right to enter the house (is the owner occupier) then contact a locksmith to open it up for him.

Now whether he'd want to stay under such circumstances or just retrieve his stuff is another matter.

He can't break into his own house.

Break the door in and get a locksmith to change the lock again, this time with only one key - his own.

No, she has no right to stay in the house at all.

If he doesn't want this to drag out for ages, he needs to take action. Get a locksmith to change the locks, pack all her stuff up and move her out.
  • Thank You for all the replys. As i said he cant get to the property for a while...he is now worried about what other damage could be done while he is away...I did get to at least keep a check on his property but as i now don,t have access cannot do this for him. Its a very delicate situation they also have a small child together which we are now bei ng excluded from seeing. She wont answer any calls from my son or us re the child...he was more than happy for them to stay at the property while he was away to avoid house being empty..they have never lived together legally.

That changes things. Mum and a child in situ have far more rights than angry ex-girlfriend.
  • Even tho it has never been their home and she has never contributed to any bills?

No, she doesn't have any rights to change the locks.

What do you mean about it not being their home? Has she moved herself and his child in since he left the house?

You could always wait till she's out for the day and have the locks changed again
Needing to lose weight start date 26 December 2011 current loss 60 pound Down. Lots more to go to get into my size 6 jeans
  • They have only lived in my sons house while he has been away...he agreed to her and the Child being there as at the time they were in a relationship and she had been living elsewhere.. My son is still paying the mortgage and until now the bills...there is no Occupation Order in place she has no legal right to be in the property only a word of mouth from my son that they could stay in the property...now he was more than happy for that arrangement to stay in place while there was a ongoing relationship.
