  • Hi, I made a claim to the airline (Thomas Cook) last November which was rejected, I forwarded to CAA as per the information on this site. CAA replied advising that they had upheld my complaint and were sending the claim back to the airline with their decision. Anyone had the same thing and any idea how long for the airline to get back in touch as no mention of timescale on the CAA letter, just that the airline would reply to me again.

    Some more details would be good. When did the CAA write to you? What was the cause of the delay?
  • Hi i travelled to Vegas in 2011 and was delayed in flight by 7 hrs!We missed out connecting flight subsequently one nights stay at Bellagio because of this.

    When i requested a refund on return of the trip i was given $200 dollars off my next trip. this didnt sit well with me and at the time thats all they were willing to offer. US Airways.

    Now this legislation has kicked in im thinkin to write to them again but would i get anything more?

    Im ideally seeking compenation for 2 adults (£1040 for the delay)

    Do you think i can also get 1 nights accommodation back (£90)evn tho they put us in a crappy B&B ?
  • Hi, went through original complaint form etc but thomson stated that could not foresee staff illness so no payout! Has anyone managed to get payout re tom1315 on 10072013?will write back challenging their reply. Re mollymol put claim in with all those on your booking ref. each seat is 400 euro!

    Having staff on standby is a reasonable measure to avoid staff illness.
    Staff illness is not 'extraordinary circumstances' so get back to them.

    The answer to this is probably staring me in the face, but I've not seen it.

    Should the airline pay the same compensation to infants who travelled free? We were delayed 10 hours so claimed 3x€400 for me, my wife and 2 year old daughter. They have coughed up for my wife and me (I'll post the details in the relevant airline thread) but they say that my daughter is not entitled to compensation as she went free.

    Surely she was just as inconvenienced regardless of ticket cost or lack thereof? Not sure of the regulation here.

    The regulation refers to 'passenger(s)' irrespective of the fare paid, so if your daughter was named on the passenger list, then she's entitled to compensation.
    Some airlines may list infants as just say 'infants-3nr' on the passenger list and deny that they are passengers.
    Is your daughter named on a boarding card?

    Article 3.2 of the regulation states it doesn't apply to passengers travelling free of charge unless tickets issued by frequent flyer or other commercial programme.

    The regulation is quite clear, all passengers, irrespective of age, that have paid a fare, are entitled under the Reg. Doesn't matter if the fare is reduced for a child, as long as it was a fare available to the general public.
