My feelings are, write back and point out that if you win as a single claimant you would make additional claims for all the other individuals on separate basis requiring far higher costs for them to payout in the loing run, as they will have no defence for an identical case?

  • Hi all
    I have put in a complaint to Qatar for a delay of over 24 hours nearly 2 years ago on a flight from LHR to TVR in India. They took several months to respond but in July they replied quoting extraordinary circumstances of a technical issue of FCMC identified on the plane prior to it's take off from Paris - the plane was then due to go to Doha and then back to London for our flight 2 days after the technical issue was identified!
    From my research I think the extraordinary circumstances (if the issue with the FCMC can count as such) has to take place on the actual flight or immediately prior to it and I am sure there was a regulation or case which supported this which I cannot find now.
    I would also like people's views on whether I should bother going to the CAA or go straight to small claims and if there is any template letter before action specifically for these cases.
    Any suggestions most appreciated.

    Suggestion 1. Don't double post.
    Suggestion 2. The irony that you are on a thread entitled FAQ's, where the opening post is a long list of FAQ's, and answers, that took a good few hours from several volunteers to compose, and then you ask if there is a template letter, isn't lost on me :D

    Germanwings is wholly owned by Lufthansa, so perhaps try that thread.

    I have looked for advice on this but have been unsuccessful, it’s a general question. My situation is regarding BA however I thought this would be the best place to post my question. Any advice would be greatly appreciated.

    The event of “Industrial action” is deemed to be an “extraordinary circumstance” which exempts the airline from being liable to payout compensation. However does this give the airline the right to cancel a flight that is outside (on the boundaries) of an industrial action period without being liable to payout compensation? (I am assuming they are claiming that it affected the schedule for later flights).

    Example (my situation)
    Italy recently had an air traffic control strike from 12 noon to 5pm. My flight was due to depart at 5pm (on the boundary of the strike). My airline decided to cancel the flight which I deem to be an extreme measure, another solution would have been to delay the flight (a much better solution is my eyes).

    I have submitted a claim, which has been rejected as “Industrial action” is an “extraordinary circumstance”.

    I have done some research and have identified that once airlines have identified the existence of an “extraordinary circumstance” they must explain what reasonable measures it subsequently took to avoid the disruption. The flight could have been moved forward or delayed as the industrial action period only lasted for 5 hour. The airline decided to cancel the flight, can this be classed as a “reasonable measure” to avoid the disruption?

    I’m hoping someone might know the answer to my question. I’ve tried to claim compensation for 2 flights I’ve taken. Both fit the correct criteria e.g. over 4 hours and over 3.5km. However, for each booking, I got a small discount from a family member who works in the travel industry.
    I’ve been told that ‘The EU denied boarding regulations state that a claim for compensation can only be made where a booking has been made at a price available to the public. Therefore, bookings made using a discount are not eligible.
    Does anyone know if this is correct?

    Yes Ally - this is correct. Special fares for staff or other private groups are not eligible for compensation.
