FAQ's to flight delay compensation queries

Airline: Asiana
From: Heathrow
To: Sydney via Seoul
Date: 22 December 2010
I booked this flight with Trailfinders which was due to leave Heathrow during the snow disruption in December 2010. At the time passengers were advised not to turn up at the airport unless we had received confirmation that their flight would be taking off that day. This was a trip of a lifetime for me so I took the chance and travelled to the airport in the hope that I'd be able to get more information.
All flights were delayed but some were taking off. I received no contact whatsoever from the airline about the status of my flight and there were no announcements at the airport and airline reps to speak to. It was as if my flight did not exist at all!
Once I finally got through to Trailfinders they agreed to look into it for me and a few hours after I arrived at the airport, was told that I'd been rebooked on the flight departing 3 days later (on Christmas Day!). I did eventually take off on the rescheduled flight but because of the delay I missed a flight I'd booked to Melbourne to watch the Ashes and also a hotel booking for 2 nights.
Now I know I can't claim for any weather related delays but do I have a claim for being left stranded in the freezing cold, outside the airport in makeshift marquees that were put up to house delayed passengers, and not being contacted to confirm that my flight was cancelled?
Thanks!0 -
you are entitled to reimbursement of expenses relating the the length of the delay. If you ended up booking a hotel while you waited and meals etc, you should forward receipt for reimbursement
Did you make a claim through your travel insurance at the time for the missed Melbourne flight, lost hotel?0 -

Thanks Caz3121 - no considerable expenses as I only live a few miles from the airport. I didn't make a claim for the Melbourne flight and hotel because a friend of mine made that booking and it seemed like a waste of time at the time. Thanks anyway0 -

I am incredible frustrated with my Monarch claim from September 2012. I feel that the airline are simply stalling for time and waiting for me to give up.
I have complained to AESA (the departure airport was in Spain) and they have responded that the airline didn't respond to their request for information and so they have advised the airline to pay. Since then I have had an e-mail from the airline telling me they will contact me again in a month but it might take longer because they are still investigating.
No investigation takes this long!
Hi. I too am struggling with an airline (TUI) who seem to be fobbing me off with jargon and ignoring letters etc. I'm at the point where I have threatened to refer matter to the CAA, but have realised that they won't del with it as it was a flight from Ibiza. I gather now I need to refer to the Spanish Authority AESA, but not sure how to go about it? I have been to their web page but all in Spanish, could you share with me how you processed your claim through AESA? Many thanks0 -

Gappygilmore, the CAA here in the UK referred my case to AESA on my behalf. You could try this if this is the way you want to proceed. Also if you google AESA it probably does give you a link in Spanish to their website but click on where it says ' Welcome' on the top line of their homepage and that will translate it for you.
There is a link on there for you to submit queries to them.
The general advice on here as I'm sure you will have read is to send an LBA to the airline requesting that they send you all the facts and their version for the reason for the denied boarding/ delay. Or you will start court proceedings within 14/21 days
Starting court proceedings and maybe seeing this through to the end of this process is the only way you will see any compensation you are due.Successfully sued Ryanair in 2013/14...and have been 'helping' litigants since then.
Current known score:-

what is important is the arrival delay, not the departure delay. It is very possible to depart over 3 hours late and arrive less than 3 hours late0 -

And "arrival" generally means wheels down, rather than arrival at the gate (which can obviously take some time).
I would only add that Easyjet have been pretty good in their response to this Regulation and appear generally to have played fair, so I doubt they're trying to mislead.0
