    Hello all,

I went on a package holiday to the Dominican Republic in May 2011, where my outbound flight was delayed. I don't *think* I'm eligible for compensation, but thought I'd just do a quick check beforehand before scrapping the idea. The details are as follows:

Outbound flight: Manchester (MAN) to Puerto Plata (POP)
    Date: 27/05/2011
    Flight no: TOM194
    Scheduled Departure: 09:15
    Actual Departure: 12:18 (3hr 3min delay)
    Scheduled Arrival: 13:15
Actual Arrival: 15:39 (2hr 24min delay. This is why I don't think I'm entitled to compensation. The departure delay was over 3 hours but the flight was quicker than expected.)
    Distance: 4240 miles

Is anyone able to confirm either way if I can make a claim based on these details?

    Kind regards.

you are correct that there is no compensation - even though you left over 3 hours late, they made up time so the actual arrival time was less than 3 hours after the scheduled arrival time = no compensation
  • I would like to claim for a flight we made in 2008 which should have arrived back in the UK from Cuba during the morning of Christmas eve. However, it was delayed by nearly 10 hours and we therefore arrived back after all the shops had closed and were unable to do any food shopping. I have been told that I need the flight tickets and proof that I was on that flight. We booked through a First Choice travel agency in our town but that has now closed. What can I do to get proof? I don't think Tui will entertain a claim without this.

    hi

i am fighting First Choice with a 24 hr delay going to kenya in 2009, i have taken all proper procedures & even sent photocopies of my tickets, boarding cards etc, TUI are trying to say they want nothing to do with it, but i am still fighting hard. Go through all the relevant letters from this website, edit where necessary, send a letter to first choice HQ direct. hope this helps a little:)

Their website lists the following London office:

    Reino Unido
Dir: Unit 50, Skyline Village Limeharbour Road, Docklands
    Londres E14 9TS, Inglaterra
    Phone: 44(0)20 7538 5933
    Fax: 44(0)20 7093 1538
    E-mail: cubanasales@cubanacan.co.uk

If that's their own office, serve proceedings there, get a judgment and send bailiffs into that office to seize everything in it (except the staff of course!)

Thanks blond mark, however this is the address and telephone number I had found myself and was also given to me by the CAA. I have sent a letter there and emailed them. The phone number no longer exists.

We endured a 24 hour flight delay over this weekend. It was a mechanical fault that caused the delay plus the crew went out of hours. We are claiming on our travel insurance for an extra night and meals etc which is very straight forward.

However my question is: my husband purchased 3 premiership football match tickets costing £600 for a Sunday game, due to the 24 hour delay the game was missed and the tickets went to waste as we were sat on the aircraft until midnight Saturday night not know what was going to happen. Can these tickets be claimed for and if so who do you go to? The airline or your travel insurance?

Does anyone have any knowledge as to what is deemed reasonable in this circumstance?

You cannot claim from airline for tickets but you may be able to claim off your insurance. Depending upon distance you were from UK airport there are varying levels of compensation the airline has to pay you. Suggest you post on thread relevant to the airline you (eventually) flew with.

Is it possible to claim under the Montreal Convention for the loss of the amenity of the tickets?
  • I started a new thread here but should have probably posted it in here, anyone care to give me some advice?

Cant post the link, but it's the compensation with BA thread under the stickys.
  • December 2006 I booked 8 seats for our family to holiday together in May 2007. They were from Birmingham-Barcelona with Iberia (since taken over by BA) I rang a few days before our departure to check something about seats and was horrified to learn that apparently the flight had been cancelled months before. I had no notification of this. I had paid on my creditccard but this was not refunded. I spent two days hurriedly rearranging flights from Heathrow. This necessitated taking two cars and two car parking places in London. With three young children this was extremely stressful and expensive. I am pursuing the claim with BA but wanted to know whether the claim should be for the return flights, ie. douible the rates lised on the compensation guide.

Can I also claim for the extra costs?
