You are definitely entitled to compensation. My flight to New York 9 months ago with BA was delayed by 4 hours due to a technical problem. BA rejected my claim so I went to the CAA who took months to do nothing then said they were sending it back to BA without making a decision. I e-mailed BA again and quoted EC Reguoation 261/2004 and two weeks later received an email stating we were entitled to 300 euros each so we got £597 for two of us. DON'T GIVE UP IS THE KEY.Hi,
We were delayed for more than 28 hours on a flight from Orlando to Gatwick last year. I wrote to complain to Virgin who have replied and are very apologetic but only offered a few airmiles and because my wife does not have an airmiles account she has nothing.
I think we qualify for compensation however, reading the guidance on here it says they are not liable if its a safety issue. How is a safety issue defined?
This was the reply from Virgin for why the flight was delayed.
"I'm sorry for the delay to your flight and for any inconvenience this may have caused. The disruption itself was due to an unexpected technical issue discovered shortly before our scheduled departure. The fault was part of a fire alert system which would notify our flight deck team of a fire within one of the aircrafts engines. I'm sure you can understand just how crucial this is and how important it is to be active and fully operative when flying. "
Do you think we still have a case for compensation?

Not given up quite.
Virgin rejected my claim and so I went to the CAA in around end of May, I chased and chased and chased then eventually they said in August that because the rules have changed they sent everything back to the Airlines and you would here in due course.
I saw on the website it said the airlines had until September to answer and so I contacted Virgin and they said what is the reference, I said I did not have a reference as CAA did not give me one, they said they could not continue without a reference.
I went back to the CAA and they said they could not give a reference because they sent them all back to the airlines.....
I complained to the CAA that this was a shambles and that being passed from pillar to post was not acceptable. That whole complaint passed them by and said you need to contact the airline.
And that takes me to now.
Part of me thinks can I be bother with dealing with these organisations as after around 40 communications its getting tiring..
The other part says the way Virgin treated us at Orlando and the rest of the passengers was not acceptable in any form, it was shocking from an organisation I had expected a lot more from and I want to give them a bloody nose to put things right at Orlando.
Strangley, I had sort of decided the only way to settle this was in court and downloaded the forms from here yesterday.
Maybe, I will write to Virgin again and give them another chance to redeem themselves. Do you have to supply all the original paperwork again or just quote the previous claim?
Although I had to apply three times for my claim last time, they could only be bothered to reply once that it had been rejected, to my at the time, 4 year old son.......
They could have sorted this earlier but just knocking a couple of hundred pounds off the price of our next flights. Not much considering we paid around £4000 for just our flights!
I will let you know if I get anything.

Popeshill - better posting on the Virgin thread but as you move over there read this link as it will indicate the level of likely battle ahead. The guys fronting this claim have a decent facebook page as well.....

I've claimed for a delayed flight back in May 2007 with American Airlines to cut the story short they have declined quoting.
"The time frame for such claims is determined by the laws in the EU country of your travel, which in this case is Dublin, Ireland the statute of limitations law is six 6 years from the time the claim is initially submitted. Therefor, since your scheduled travel was May 4, 2007 any claim submitted after six 6 years (may4 2013) is not considered.
Anybody out there that can help or guide me would be much appreciated. Thank you0 -

I just wanted to report that Blueway have just come up trumps for me. They obtained maximum compensation for myself, husband and daughter from July 2010 when BA269 flight to LAX had to turn back to LHR due to technical problems. We took off again a day later and missed a day in Disneyland.
Blueway succeeded where I failed - I already had written 2 letters to the company in 2010 just after it happened - they gave me £40 in vouchers at the time - not enough to even cover the phone calls I had to make to ring the hotel/taxi company etc (although they did put us up in a hotel - but not the same as an extra night in Disneyland is it?)
Blueway have just paid me £1126 into my account - well done to them and I would definitely recommend them. BA of course challenged the claim strongly but Blueways persistence paid off.
they are fighting another case for me also - Virgin flights severely delayed coming back from Orlando the year before (I know I have all the luck)0
