New! Flight Delay and Cancellation Compensation Board
Comments

Try telephoning Etihad and attempt to book on the original flight as an anonymous? See what happens? If you can book a seat then go back to agent and play merry hell.
Ok so the agent called me this morning to complete an astonishing u-turn and confirm that my sisters had been reinstated onto their original flight, after originally claiming that there had been a schedule change and the original flight had been cancelled!
All well and good in the sense that my sisters can arrive back in the UK as intended however 3-4 days of anxiety and stress are not good, especially given that my sisters went abroad as a result of a family bereavement!
It was only resolved after I cornered them with the facts - that the Etihad website clearly showed the flight was still valid and was being updated daily with the number of available seats!
I don't want to let this one lie, so I would appreciate any advice on what grounds I have for some form of compensation, be it an upgrade or monetary - any thoughts are welcome?
Thanks,

I used the compensation claim template from this site (excellent thank you) to send a letter to Thomson for a 22 hour delay on flight from the UK to Cuba, included letter from TUI acknowledging delay.
Got an initial response then nothing, sent TUI another letter a couple of months later complaining about service and asking for a full explanation.
TUI replied with an in-depth response explaining that the problem was a fuel leak on the aircraft which would not have been discovered in regular maintenance and would therefore be regarded as exceptional circumstances and not liable for compensation.
My questions to the forum are has anybody had similar circumstances, is it an exceptional event and what do people think the next step is.
Cheers,

I had a flight 2 years ago from Rio, Brazil to Paris, France with Air France, that was cancelled. I had booked this flight through STA, and the following flight back to Manchester was with Flybe. When I got to the airport, the flight was cancelled, and I had to wait around 13hours to go on the next Air France flight-with one food voucher to cover this wait in the airport.
I emailed Air France-they said it was due to an 'unexpected' technical issue (when are they ever expected?), said I was not due any compensation, but offered 100 Euros off my next flight with them.
Following the MSE guide, it says if your flight is from non EU to EU airport and operated by EU carrierich it was- to use the CAA website to claim through them.
Their website says it only handles claims flying to the EU on a non-EU airline. Does anyone know who I should be contacting instead?

As Mark2spark once asked - brilliantly in my view - does your Mam still get your tea, Tomz? (Read the FAQs and the last 20-odd pages of this thread. The search box is helpful too.)0

I was on a flight from Zurich to edinburgh last month with a 6 hour delay. The cause of the delay was a baggage handling truck damaged one of the engines. BMA Regional say they are not responsible and that we are not due any compensation!
Any views please0 -

The idea is that baggage agents, being employed under sub contract by the airlines, are effectively airline staff, so any damaged caused by a staffing accident is NOT an extraordinary circumstance.
The various rulings give mention of how the airlines can claim damages from third party agents, therefore the buck stops with the airline.
So, you've commenced your claim, so now you write back NBA (see the FAQ's), say you don't agree with their decision, ie cos a principal and agent contract existed between them and the truck driver they are still responsible, and that you'll be off to court in 14 days unless they settle.
And then do it.0 -
There was an interview with a deeply unimpressive CAA person on Radio 4 Money Box programme just now (Sat 25 Sep). It'll be on iPlayer shortly I imagine.
