  • We were delayed for 4hrs from a flight from menorca after an airport worker who controls the ladders, drove into the side of the plane causing cosmetic work.
    The airline had to fly out a specialist from the uk to look at the plane to be told it was cosmetic so could fly.

    Just wondered if we have a case or is this deemed extraordinary circumstances?

    If you search "airport worker" you get 18 posts, and there have been numerous others with similar circumstances. So you need to do a bit of research.

    But the bottom line is that this should not be regarded as extraordinary - though a judge could deem it so. (And at least in one instance has).
  • Hi, I am looking to put in a claim for my delayed flight last month returning from Lanzarote, we are a family of four who were booked on a Monarch flight from Arrecife to Manchester, on check in there were 5 desks open each with long queues. After a 45minute wait in the queue we were one family away from checking in and they closed ALL 5 desks with over 120+ passengers left to check in. A notice was then displayed stating that due to 'technical difficulties' our flight was now delayed and a new plane was being allocated to the remaining passengers and a new flight number was designated. In total we were delayed from the original arrival time by 3 hours 15 minutes, would I still be entitled to make a claim even though a 'new' flight was allocated with a new arrival time? On investigation to the circumstances to the delay it seems that the original plane Monarch had designated to our flight an Airbus A330 had to be allocated to a new flight last minute so 2 smaller planes were allocated without our knowledge. Sorry to ramble on but before I made a claim I just wanted some advice. Cheers

    In a word, yes. It is a delay. Read FAQ. Get your template letter written including NBA then any further posts ONLY on the specific Monarch thread.

    Actually, I don't think it is a delay. If two planes were sent, and half the passengers were allowed on one plane and the second plane came later, that is denied boarding - for which there is a very limited defence.

    When you say limited defence, do you mean on behalf of the airline and I would have more chance of success in the claim?

    Yes. I don't believe you can use the "extraordinary circumstances" defence for denied boarding.

    Seeking some urgent advice please!!!
    Last week my sisters booked a flight at the last minute to a destination outside the EU as our grandmother had passed away.
    We booked tickets on Etihad through a reputed travel agent. The outward journey was fine however 2 weeks before returning the travel agent has called us to say that due to an unknown reason Etihad have cancelled the bookings and are offering an alternative flight.
    I'm not sure whether we have been bumped due to over-booking however I checked the Etihad website and it is still showing the return flight as being valid.
    The original return flight was on 19th Sept departing at 04:00 and getting into London at 18:15. The new flight that is being offered is also departing on 19th Sept however at 17:00 and landing in London the following day (20th Sept) at 07:20.
    The alternative would normally have been ok if it wasn't for the fact that on the same day (20th Sept) my sister needs to attend a course for which she has paid £1000's. It is imperative that they return to London on 19th Sept.
    My question is two-fold:
    1) What are our rights in terms of demanding that my sisters remain on the original flight given that the Etihad website clearly shows it is still planning to fly? Or that we are placed onto another flight/carrier on the same day?
    2) If Etihad force us to take the alternative, does this situation qualify for compensation?

    Appreciate any advise!
