I think the ECC will just tell you to send the complaint to the NEB.

i am not 100% sure it was in 2007 and 4 hours of delays, so is a long time ago, but there excuse does not sound right
You need to be precise if you are going to make any headway. As a minimum you need the exact date and flight number which you can then look up at http://www.flightstats.com to determine how long the delay was for.0 -

it was delayed for 4 hours, i know the date, the flight number the time, everything.

nikkit72, that is an example of not being precise. I interpreted your "i am not 100% sure it was in 2007" as that you were not sure which year the flight took place.
Was there not any reason given for the delay on the day of the flight while you were waiting? Did you not enquire at the time?0 -
Neil. its so long ago i cant remember the reason, at the moment they are saying that on 25/08/2007, when it was actually 26/08/2007 ( first mistake they made) they go on to say :
our records show that the aircraft scheduled to operate your flight was operating its previous flight rotation from luton to gibraltas when it becam necessary to divert the flight to malaga due to adverse weather condions ( it was a scorcher of a day as i remember being very hot in the airport) making it unsafe for us to land. As a result it was bound necessary to coach passengers from this flight to gibraltar and then coach the inbound passengers from gibraltar to Malaga which caused a lengthy delay namely the aircraft did not arrive back into Luton until 0227 26th Aug ...
they then go on to say :
having considered the factual background of this case, in accordance to guidelines we are satisfied that the disruption was caused by a extraordinary circumstances

Unfortunately in that case it's all moot because you're out of time for bringing a claim.
The limitation period is 6 years, which means court proceedings need to have been issued by 25/26th August 2013.
You can't take this one any further I'm afraid.0
