  • nikkit72, if both you and the airline both consider that the delay was down to the weather, I don't think you have a valid claim to persue.

It is still worth double checking that the airline is referring to the correct day though.

Unfortunately in that case it's all moot because you're out of time for bringing a claim.

The limitation period is 6 years, which means court proceedings need to have been issued by 25/26th August 2013.

You can't take this one any further I'm afraid.

oh ok, but im not taking to court just the NEB

  • If the airline received your claim form before 25th August 2013 you should be within the six years timeframe, but if the weather was the cause of the delay it is not worth persuing.

  • I think you need to determine ...

    1. Are the airline talking about the correct day?
    2. Were you transferred by coach from Gibraltar to Malaga?
    3. Look up the weather records for Gibraltar for that day to see if there is any justification for "adverse weather conditions" "making it unsafe for us to land"

In other words, do your homework thoroughly.

I was in Palma Majorca , they are saying the plane which was used for our flight at 0200 was same plane used at 1400 hrs previous day in Gibraltar this is where the delay started

  • You still need to check the weather conditions for Gibraltar to determine whether the airline are correct or not.
  • neilsedaka,

You're wrong, please stop it! This must be extremely confusing for nikkit72.
