    A merger shouldn't stop a claim. But if Skywings are now a Ukranian outfit, I do not see honestly how you are going to enforce a judgement out of them. Especially as (I assume) they don't have assets in the UK.

    start with the FAQs of the applicable airline thread. You could have a claim assuming the airline is still in business and the FAQs will give you template letter etc

    Post on thread appropriate to your airline please but ensure you read FAQ's on page one of that thread first.

    I was on a flight from manchester to mexico cancun in July 2013 with Thomas cook 2.5 hours into the flight the plane was made to turn around due to a fault with the weather radar , therefore we spent 5 hours on a plane to go back to the same airport. this flight left 9.15 and was due cancun time 0130 afternoon. we then had to wait while the plane was fixed until 1730 to start the journey again. we were give £12 vouchers for use in the airport and flight. I have since contacted Thomas cook who claim this is extraordianry circumstances ?? however on the caa website it says mechanical faults do not fall under this. Please can anyone advise if I have a claim and Thomas cook are just trying to get out of this

    Start with the Thomas Cook thread and the FAQs on the first page - there is a lot of reading there (with links to other key information) but it should give you the answers needed.
    You are likely to have to take this to court to get any further - info in the FAQs about that too

    Sounds a bit dramatic and extraordinary, and a dozy Judge may simply just agree with TC at a hearing.

    Perhaps consider a NWNF lawyer such as Bott & Co.

    Hoping someone might help

    We had a delay of over 24 hours on a return flight from Cancun to Gatwick. On the day of our return everything was going to plan right up to the time of departure. Some of us passengers had even boarded the plane and taken our seats ready for take off. It was at this time we were then quickly asked to leave the plane.

    Amongst utter confusion we were told to go to a different gate where there was another Cook airplane waiting. While at the same time the passengers who had previously been at this other gate had started boarding our plane. Confused we watched what was our plane take off while we were still waiting.

    It was at this time everyone started to demand what was happening. It was then they informed us that the plane we were now given had a technical fault and it would'nt be until tomorrow before they could even fly another part from London. When questioned over swapping planes, they answered it was to T Cooks benefit that the Manchester passenger commandeerd our plane because of some knock on effect.

    We contacted T Cook several times who have dug their heels in saying our delay was due to a technical nature, which were extraordinary,

    I find I difficult to swallow about technical natures and such like, because the plane we had took off on time but to Manchester not Gatwick. Reason for our delay was T Cook denied us boarding our scheduled flight and bounced us to one they already new had a fault and a long delay.
  • In September we went on a flight from Manchester to Gibraltar and was delayed for 6 Hours. We got an e-mail from the airline about a week later which acknowledged they were at fault but said we could only claim compensation through our Travel Insurance. The other thing i should note is we were given a £10 voucher per person to spend in the airport. Is this true or are they trying to bluff their way out of it. Any Comments or advice would be much appreciated.

    not sure you had my message but i am sorry about posting on a few threads, i did beleave it was a sure way to get a answer. i am new to this forum or any other type of forum so please bear with me.

    but as my delay does not come under denied boarding nor did my original plane have a tec-fault i do not know what to edit or claim under

    Ok. You were not denied boarding, in the legal sense, because that would mean your flight left without you being allowed on it. It didn't. Your flight was delayed. The plane you believe scheduled to perform your flight was transferred to another flight - but that's not the same thing. I would argue that your flight was delayed due to an operational decision by the airline.

    As for what next, read the FAQs on page one of the airline thread and have a good read of a generous selection of the other posts. You are going to have to start court action at some point if you are to make progress with your claim - but all the info necessary is in this forum, if you do the work.
