    Morning, any assistance would be helpful.

    Me and the misses flew from Croatia in 2011 and was delayed 4 hours which is fair enough but the problem i have is that Croatia joined the EU in 2013.
    Therefore the departure airport is in the EU but wasn't at the time of delay - does this count towards a legitimate claim??

    Interesting question! Before I think too hard about it, tell me which airline you flew with. If it was a European carrier, it doesn't matter whether you flew from Mars, as compensation would still be payable.

    Thanks for coming back to me.

    We flew with Easyjet from Split to Stansted.
    I've already looked up on Flightstat and it confirms that the delay was indeed over three hours.

    Then you have your answer: you are covered by the regulation (you need to read the MSE guide, as this is all covered there). Whether you qualify for compensation depends upon the cause of te delay - and whether it is "extraordinary circumstances". Do some reading up, including the FAQs on page one of the easyJet thread, and if you think you have a claim you'll know what to do.
  • I understand that delays due to poor weather conditions are not the airlines fault, but if all other airlines are running smoothly to and from the same airport, is this the individual airlines fault

    Depends where the weather problem is;

    At the departure airport,

    On the flight path or

    At the destination airport?

  • Our honeymoon in April 2006 ended up a living hell when Virgin Atlantic permanently cancelled their Gatwick-Nassau (Bahamas) flight route. Our return flight was cancelled before we left but we were not informed by Virgin. We only found out at the pool from another guest! Our rep was no help at all and we waited for a response for two weeks while in resort. We ended up having to leave our honeymoon early to get rerouted to Miami. The new flight that we were supposedly booked on did not have any record of us so we waited ages to get that sorted out. We arrived back over 6 hours late in Heathrow (not Gatwick) and therefore missed our connecting flight to Newcastle. Virgin did finally pay for a connecting flight for us, but again this took hours to arrange. I complained immediately on return and was told that we were not entitled to any compensation. I pushed further and received a complimentary £200 Virgin Holiday voucher which expired soon after and we did not use.
    I have recently became aware that I indeed was legally entitled to compensation via this website and applied via the EU claims route, but of course travel in April 2006 is now out of the claim period. I've written to the Civil Aviation Authority and they have returned with the same message. Any idea what I can do or am I simply too late?

    Too late, I'm afraid. You would need to have started legal proceedings within 6 years (England & Wales).
