    Missed my return flights from Lyon to LBA, via Amsterdam yesterday along with hundreds of others as we discovered that Parisienne skiers and other French drivers really do not have the first idea of how to drive in snow causing me an 8 hour delay on motorway. I had allowed 8 hours for a 2.5 hour journey.
    Joint Air France/KLM desk all shut up at 7pm, and phones not answered for ages.
    Eventually spoke to someone, offered a new flight next day, €1000 each in business. I think the tone of my laugh suggested I wouldn't be accepting. So pay 10x as much for almost identical seat, plane, staff journey, just to get a free newspaper? Pure profiteering and extotionism. What's the bet our seats were resold to those earlier late arrivals?
    Got a BA connection for £250 (and a free newspaper) ;). That departed an hour late but still looking OK for connection.

    I'm really sorry to be the one to break the news to you JP, but it's your responsibility to get to the gate and be on time for your flight, you can't blame the French for everything! Therefore you are unable to claim under EC261/2004 there is no provision in there for inadequacies of French motorists. Perhaps next time you'll be on time ;):rotfl:

    I don't know anything about the flight delay laws in Canada I'm afraid. I'm not sure you could use the UK Courts as the claimant wouldn't be a UK citizen or a UK address.

    The reg applies to all passengers regardless of nationality. The flight began in the EU so EU261/2004 applies regardless. If it has to go to court though then I think it will probably need to be a court within the EU. But I think for example, useing somebody in the UK to represent you would work.
    The above is just my opinon - which counts for nowt! You must make up your own mind.

    Thanks for that razorsedge, I did think about the ESCP, but that wouldn't work because obviously the Claimant is not within the EU. I think the safest way would be to try and go down the NWNF route, but do let us know how you get on Dali83

    You're welcome, I realise that you are British but the delayed passenger (the applicant is not), hence the difficulty.

    Pop into the Ryanair thread to learn all about the ESCP but I doubt it will help you, but NWNF might well and it stands for No-Win No-Fee, there are a few Solicitors mentioned on these threads, the more often is Bott & Co, since the Huzar victory they appear to have a good reputation, I'm sure others are available but can't recommend any of the others.

    Happily, because I wasn't a skinflint and got proper travel insurance, all my extra costs are covered, bar a £55 excess = smug :cool::D
