  • Hi Dali83,

Have a read of Vaubans guide, out of interest where was your flight from and to, do you live in France? Would you be taking out proceedings in France?

    Cheers,

    Dear all,

I made a claim for a cancelled flight with Air France back in 2010 and their reply was that they cannot compensate for more that 2 years according to the Statute of limitations.

I have contacted Skymediator and they confirmed this as well.

Is this correct that in France Air France have this time limit?

Is there anyone who claimed with them recently outside the time limit?

    Thank you

I am eager to get a helpful response.

According to your post you have claimed in 2010 and got reply that air France can't compensate you for 2 years back ticket which means that you flight was cancelled in 2008. If it is true and you did not start any legal procedure then you have lost you money. Nothing can happen now.

I read this as the cancelled flight should have occurred in 2010 ie 5 years ago - therefore (in the UK) the poster is within the 6 year threshold but needs to move quickly to sort the matter out/instigate a court claim.

That's how I read it 111KAB, that's why I asked if the poster lived in France because we know the regs and the interpretation of them here, perhaps in France the limit is two years? I don't know

  • I was booked on an Air France Flight from Johannesburg on Sunday evening 15th February - The flight was cancelled due to 'crew rest' but I believe this followed industrial action in France. I arrived in Dublin 5 hours 18 minutes late after re-routing via Amsterdam. I am hopeful of a claim but would be grateful to know how other travelers have fared. Regards.

KLM have already accepted liability for delay on 14th Feb, payment on it's way. Take note Jet2. Even KLM aren't relying on their own van Der Lans case to deny or delay payment of compensation due.
If you're new. read The FAQ and Vauban's Guide

You don't have much luck with on time flights though JP, isn't it just typical your first flight in a couple of years, you even avoid J2 and yet you're still delayed......

..... although I bet if you are completely honest, I bet you were getting ready to lock horns with KLM ?

Well if the delay, WAS caused by industrial action, that's outside the airlines control so no compensation i'm afraid, however, the good news is that's if it's for operational reasons, then that is under the airlines control so you have a claim, read through Vaubans excellent guide, then re-post any questions you have after reading it.

    Good Luck

Hi Novice and thanks for your reply.

Could you guide me to Dawson please as I am new to the site.

Also, can I claim for an infant who was 9 months old at the time.

    Kind regards

Quite a bit of confusion going on but here's the link to Dawson which should you be in the UK will settle your mind

Apologies for duplicate posting (this is also on the Huzar thread) but for those applying to have stays overturned, you might find it useful to include this document from the Supreme Court. It doesn't add to what is in the public domain, but I think the seal adds quite a bit of gravitas!

(Many thanks to Bott and Co for making this available to share with you all.)

And just to make it clear, Dawson argued that the limitation was 6 years, the Supreme Court agreed
