    I am guessing this was the 3rd October 2007 as this was the only date in the month with a delay (288 mins) but as per the FAQs the airline can (and likely will) decline any claim knowing that there is nothing further you can do - if you are in England you would have needed to commence court proceedings within 6 years (and 5 years if Scotland)
  • Virgin VS52 (April 2011) flight delay compensation claim denied. They can't even get the flight schedule correct! As usual they use the 'extraordinary circumstances' excuse to not pay up, now I have to take my claim to the CAA.

    Has anyone been successful with this particular flight or any for the Caribbean?

    I think taking your claim to the CAA would not be a great idea. Search through some of the forum posts to see why.

    At the point of repair, our flight crew would have unfortunately exceeded their legal duty hours in they had preceded with the flight. Therefore, in order to satisfy the legalities of crew working hours and minimum rest periods, we had no choice but to delay the inbound flight over night, which resulted in a reactionary delay to your flight'

    So basically blaming the flight crew hours for the delay.

    So what i am asking is, its their 1st point valid, if not what should my response be. Also should i include the flight crew reference in point 2 in my response to them.

    Hi Again Guys

    Having received no further correspondence from virgin since i told them the excuses for not paying was not valid for declining my claim, what should the next step be. Having read around the forum i have seen that further correspondence seems to have been ignored on virgins end and i wish to pursue this further. What should the next step be.

    Was thinking about previous flights last night and remembered sitting in the UC lounge at Gatwick for ages after all the morning flights had gone one year.
    Just dug my expired passport out and we flew on 11th May 2010.
    Was flying on VS43 to Las Vegas and we departed 5h 53m late and arrived in Vegas just over 6h 30m late.


    If I remember correctly the delay was caused by a windscreen that needed replacing (may have said due to a bird strike when landing).


    The FAQ seems to suggest I could claim.
    Seems to good to be true, what do others think?

  • I just want to say a big thank you to everyone on this site for all the information and advice. I just received an email from Virgin this morning advising me they making a bank transfer of €1225 to my bank account.
    My son and I were passengers on this flight from Gatwick to Orlando which was delayed by 27 hours due to an oil leak in one the engines which led the whole engine needing replacing. Their spare plane was also not available due to damage by lightening the previous day!
    I first made a claim in August 2013 which Virgin rejected due to "extraordinary circumstances". I complained to the CAA ( which was a waste of time) who asked Virgin to reconsider but still got nowhere.

    In December 2013 I commenced proceedings in the small claims court from Dublin, Ireland. I received a letter from the small claims court approving my claim on the 31st December and this morning, the 07th January, I received the email from Virgin which said they did not admit liability but see no value in disputes of this nature with their passengers and would therefore like to settle it!!!

    I'm so glad I didn't give up and found this site. I am just amazed how quickly they paid up!!

    Hi Kim your story sounds exactly the same as mine except my flight was from Gatwick to Vegas on 27 August 2012 (VS043). They ignored my correspondence but paid in full when I sued them.
