    It's not as simple as making an application. It is very likely you will need to take the initial legal steps to take them to court, although they may well then back down before you need to go to court.

    Unless you have the (significant amount of) time and ability, I am increasingly of the view that people should consider engaging a NWNF lawyer, once (and only once) the airline has rejected an application for compensation. (The application is easy, and the airline may just say yes - they sometimes do!)

    therefore would you advise on using a company to start with or can i go to a company after they have rejected it??

    As Vauban says, make the initial claim to Virgin but expect a knock back and then go the no win no fee lawyer route.

    Our claim for compensation from Virgin for a 5 hour delay on flight VS015 on the 23/06/2012 has been declined by Virgin due to exceptional circumstances.

    The company they had delegated their flight planning too had a systems failure, so they're claiming ECs. My opinion is that if you've delegated something critical to a third party, who then fails to deliver, that shouldn't come under exceptional circumstances.

    Given that this affected most of their flights that day, has anyone taken them to the small claims to test this?

    Im so glad I decided to check my previous flights.
    Im claiming for 3 flights now since 2010.


    VS43 on 23/10/2012 4 passengers
    VS43 0n 11/5/2010 2 passengers
    VS44 on 18/5/2010 2 passengers


    If anyone was on either of these flights feel free to get in touch :)
  • Hi, just wanted to say a big thanks to anyone, Esp Martin and team, I received a cheque from Virgin Atlantic today for £497!!!

    All I did was go to their website, printed off their own EU claim form and stuck it in the post. I mailed it off two weeks before Christmas, got confirmation of receipt over the holidays, cheque came today.
    No solicitors, no legal advisors, just filled in the form.

    I was due to fly to Tokyo a couple of weeks after the Earthquake in 2011, when I arrived at Heathrow they told me the flight was cancelled, due to 'unforeseen circumstance' and I could fly out 9 hours later. I'd been offered a full refund a few weeks before due to the problems out in Japan, so I had a suspicion the flight didn't have enough people to make the flight worth flying.
    I applied, I won, no quibbles on their part. :T

    Sorry, I meant "join forces" as in "exchange notes" not claim with someone else.

    FLIGHT VS27 LGW-MCO (16/12/13) Delayed 5hrs 33mins
    I filled in the EU compensation form on 15/01/14,got reply 21/01/14.
    As expected declined due to'extraordinary Circumstance'.
    There reply stated the 'In Flight damage to the aircraft during the preceding flight caused by foreign object,and which required immediate repair.(basically a foreign object hit the blades and had to be replaced).

    Should i claim ? i was going to file a Smalls Claim Action,before i pay,just wanted feed back.Virgin staff only came to talk to customer after 3 hour delay.Communication of 'reason of delay' ,etc was limited.They did offer their Flight club miles to everyone on the plane.I didn't take up the offer as this is my 2nd only Virgin flight and both were delayed.

    Whether you qualify for compensation depends on the reason for your delay. Read the FAQs on page one, and reach your own conclusion. If you have specific questions, by all means post back here.
