  • Hi,

We were delayed over 4hrs this weekend returning from holiday. I have completed the easyjet form for compensation.

The cause of our delay was a knock-on from the effect of earlier damage to the plane following a bird strike (at least 2 journeys before our flight).

Whilst I appreciate bird strike itself is an exceptional circumstance and caused an understandable delay for the journey during which it was discovered as repairs needed to be made, I would question whether OUR flight delay should be considered exceptional circumstance itself. Is it right to say that since our flight was due to leave at 4.30pm and Easyjet were aware of the problem with the aircraft that morning, they should have used sensible measures to ensure we were either re-routed or another plane should have been made available?

Would appreciate advice or anecdotal reassurances.

    Many thanks.

Are you sure about that ?

He means the bird strike. Court cases, I believe, have determined that birdstrike is NOT an EC.

  • So, regardless of the whole 'knock on' effect argument, the original cause from earlier in the day might not even be exceptional circumstances - that's great news - i'll let you know how it progresses.
    thank you

In effect, neither of the issues are relevant.

My recent flight from Venice -> London was delayed by over 3 hours. I've submitted a claim but reading through Easyjets facebook page it seems I will be waiting a lot longer than 3 weeks for a reply and of course I am fairly confident I will be fobbed off initially. Im not interested in this dragging on for months. Is there anything wrong with just going straight to a LBA and then MCOL? I think 2 weeks to consider and pay up is more than enough time and the fact they dont have enough staff to cope with the volume of cases they have isnt my issue.

Does anyone have the address to where to send the LBA?

What sort of proof does one need to prepare in order to go to the SCC? I landed 2hrs and 59 mins late, screenshot of LGW arrivals board. I have a screenshot from my phone of the easyjet flight tracker which lists the arrival time as being 3hrs and 4 minutes late.* None of this feels like real 'proof'? If they mention thunderstorms, should I print off a route map and point out other flights were flying in the same direction but again, it doesn't feel like 'proof.'

*Landed vs doors opened; Im aware of the EU case saying that its doors open time that counts.

Darren - all up to you really. If you want to speed things up suggest you wait 4 weeks after your initial claim then issue 2 weeks LBA. After the 14 days go to MCOL - all issued to their Luton address.

The 'proof' you have will not stand up in court but could be persuasive. Read Vauban's Guide and wait for EJ's response to your LBA and if none and you are confident of your 184 mins delay then go to MCOL - again wait for their defence (if any) and go from there.
