They have all the paperwork both from us and Easyjet (which was sent to Bott when they were still representing us). I managed to find a copy of Easyjet defense, pretty much they are stating that compensation is not due because we didn't take the delayed flight but we decided to take another flight back to London after been delayed more than 5 hours at Barcelona Airport. There was no other option offered to us ...it will be interesting !
That's good to hear - the key point is that you were rerouted by the airline because of the delay, and the regulation makes provision for compensation in these circumstances. But I think your paperwork says all that?0 -

Yes it does. Easyjet statement says that WE requested easyjet to cancel our reservation on the delayed flight and to create a reservation on the flight that THEY moved us to after more than 5 hours at the airport.I hope the Judge will see trough all the BS!0 -
Hi Everyone,
Me and my wife were on a scheduled flight from manchester fo Belfast last friday night.
Initially the flight was delayed and then cancelled. I then checked what flights were available the following morning and fortunately managed to get us two seats.
Ideally i would have waited to get the free transfer onto the new flight but didnt want to take the risk that there would be no seats.
I appreciate that we are due compensation as the original flight should have landed around 9pm but we didnt get in till after 9am(as the flight on the sat morning was delayed for an hour or so).
The original flight was around £65 pounds in total, the new one around £130.
After reviewing the easyjet compensation form, there is no mention of what do regarding this. Does anyone have any suggestions on the best/lease hassle approach?
Cheers

Hello everyone!
Have just joined the MSE forum and this is my first post. Last Tuesday 28 June I travelled with my husband from London Luton to Barcelona with Easyjet. My flight was due to leave at 7.00 am but we didn't actually take off until nearly 1.30 pm. At about 0345am on the Tuesday I had a text from Easyjet to say the flight would not leaving until 0730am due to a flight substitution. We arrived at the airport on time and mid morning the Easyjet app was saying the flight was not due to leave until 1210 pm, again due to an aircraft substitution. However on asking Menzies staff at the gate we were told the extra delay was due to the French air traffic controllers being on strike - again! As we were only going to Barcelona for 3 nights we effectively lost most of our first day. Am looking into applying for some compensation from Easyjet and I know the delay has to be over 3 hours to qualify. I'm not sure how to go about this though as MSE say Easyjet won't accept claims through Resolver. Not sure whether to use the template letters on MSE or Easyjet's own online claims page and, if I use that, I suppose I can only claim for the 3 and a half hours due to the aircraft substitution (the pilot did say the original aircraft was "broken" when we eventually boarded and they had had to bring a new one in from Berlin) and not the portion due to the strike. Sorry to wander on but would really appreciate any input/comments available - maybe from someone who was on the same flight??
Kind regards

this guide should have your answer. If you need further, there is an Easyjet thread

I don't think compensation is payable for a delay due to industrial action, such as the French ATC one.
I was caught up in such a strike back in March. Flight cancelled. Got the water and the voucher for a snack while we were waiting to rebook.
We were delayed for two days OMG. We were given a lovely hotel and transport to and from airport. Was told to reclaim out of pocket expenses when we returned, but we didn't bother TBH.
No compensation as the delay was due to a strike.
However we were treated very well, apart from the queuing!0 -
The delay wasn't all due to the air traffic controllers - 3 and a half hours was due to an aircraft substitution - the rest was due to the atc's - it was just so annoying as we were only going for 3 days!0

Have a read of this.

So for the benefit of others, Ms Windmill and myself have been working up a draft witness statement to respond to the Judge's Order requesting an explanation of why compensation is due given the plane Ms. Windmill's party travelled on wasn't delayed.
Bott & Co rather uncourageously (in my view) dropped the case with little notice, leaving Ms Windmill to pick up the pieces in short order.
The bottom line is that Ms Windmill did travel on a flight that wasn't delayed. But she did so because EasyJet rerouted her onto it, after she had waited over four hours for her original flight to depart (and been told they had no idea when the original flight might leave). In the event, even taking the second flight, she arrived back into Gatwick over five hours later than she should have originally done.
This is the witness statement in response to the Judge's Order. I am sure Ms. Windmill would welcome any quick feedback before she sends it off.
A quick update...I was in court with Easyjet this week and we settled the claim.I was happy with the amount that Easyjet offered us.I didn't want the risk of not getting anything or for the claim to be adjourned (the paperwork was a mess partly due to Bott making mistakes and then leaving us to try to salvage the claim!).I am Happy that we can put this behind us (once the cheque clears!) considering that it has been going on since 2010! I would like to thank the forum members that helped us with the claim (especially Vauban!).I don't think we would have gone ahead with the claim without your help and reassurance:T0 -
