    A call yesterday evening from easyjet after an email received saying my claim was with their legal team.
    They are now paying out on my claim 400euro/full paying passenger. Have received another email with a consent form requesting all names and signatures of passengers along with last 4 digits of a card which they will call me to confirm as security and forward the compensation.
    My final letter highlighted the recent Uk Supreme Court ruling and emphasised the aircraft involved was irrelevant when they claimed extra ordinary circumstances for a pump fault.
    SO DONT GIVE UP ! :money:
  • An email response received from Easyjet in relation to a flight delay compensation claim for a flight from London to Venice on Easyjet by an Italian passenger states:

    "As per the recent ruling of supreme court on Huzar case, we are unable to offer you the compensation for the delayed flight for the booking reference number XXXXX as the passenger is a non-uk passenger. Compensation is only payable to the uk passengers."

    Appears to me to be a try on as the compensation is based on EU regulation, and it is the airline's place of registration and the departure airport that are relevant rather than the passenger's nationality, who is incidentally from the EU.

    Does anyone have any thoughts or received a similar email from Easyjet?

    Unbelievable. But in fact tricky. Because, as I understand it, you need to be resident in the UK to initiate legal action. Are they?
  • No, the passenger is resident in Italy, returning to Italy after a weekend here.

    I'd have thought that EC regulation would bind airlines at a minimum against claims from EC passengers?

    Surely the passenger can use the ESCC as per UK residents in connection with Ryanair claims?

    It's the European Small Claims Procedure: http://europa.eu/legislation_summaries/consumers/protection_of_consumers/l16028_en.htm

    Drop Dr Watson a line - he's the expert on this. But you can write back to say that your Italian colleague gas access to UK courts through the ESCP and they will not hesitate to make a claim if the airline seeks to discriminate on the basis of nationality.
  • Delighted to advise Sleasy Jet have paid out on my compensation claim. Had to issue small claims court proceedings , but they committed to the court a 14 day response post Huzar/Jet2 appeal outcome. Cheque received today!
