Be careful in assuming that a no win / no fee company would be a more successful route than, say JPears.
So far Jet 2 seem to be using the "sledgehammer to crack a nut" method in defending claims. And it IS working for them.

The use of the word "wasting", i would exchange for "using wisely", Dart Group shareholders must be thinking "good on ya Jet 2!".
One piece of information which would have been good in court as ammunition (possible by data request ??) would have been exactly how many cases have Jet 2 paid out paid out / declined on this issue... If a Judge could be show that the answer is ZERO / all, then he would maybe then see that they are just not being fair in denying ALL claims and that some MUST by defention be compensatable under 261 / 2004
I too am in the (hopefully) capable hands of B*TT & Co and i now know that they would have to employ the same type of industry experts that Jet 2 are using for their side, along with the same levels of tenasity, perseverance and resoluteness.
In short Jet 2 will have to be combatted with the same ferocity as they are prepared to show "our" side... I do hope B*TT & Co are prepared for this and do not focus on the "softer" airlines.
If I were JPears, i would not roll over, i too would join the B*TT & Co queue.

1. Work in supplying Jet2's initial defence to MCOL 3 hours at £250 (min?) per hour - £750
2. Work in submitting witness statement to court & claimant, including preparing witness statements 5 hours at £250 - £1250
3. Work in preparing skeleton defence and summary, 2 hours at £250
4 Full day attendance at court in Leeds, including travel from London 9 hours at £250 - £2250 plus £300 train fare.
5 2 middle management employees taking at least half day off to attend court.
I reckon about £5000 in total and I'm probably being conservative with legal hourly rates and time claimed.
Compo to me - £450

Hi,
I was delayed for 333 minutes on 17th May from Manchester to Faro. It was a group booking and there was 29 of us in total.
We were told to get ready to board, then turned away from the gate with no explanation, and told it would be an hour. An hour passed and the tv screen said to check again in an hour.
This went on for another couple of hours when Jet2 finally opened a customer service desk to issue food vouchers.
We were told the fault was caused by a part failing in the planes water system meaning there was no working toilet etc, and they were not allowed to fly without working toilets.
Jet2 has a massive check in presence at Manchester Airport, so you would think they would have parts stored ther, but no they had to get someone to drive one up from East Midlands airport, then fit it, then test it.
No other plane on standby.
How would we go on with a claim?
The lead booker has emailed them a few weeks ago but has yet to receive a reply0 -

Your next step is to write back and state that they have not provided any proof of extraordinary circumstances (don't use the word 'exceptional' ), and that their failure to reply leaves you no alternative but to put them on notice that you will be at liberty to commence court action against them to recover this debt without giving them any further notice, if they fail to settle your claim within 14 days.
And then commence court action in 14 days time.
If you're not prepared to go to court then either instruct a no win no fee firm or walk away now.0 -

Go figure.... Ok, i'll have a go.
How many people would have (i.e what percentage of legitamate claimants, who are compensatable would actually have the time / tenacity as yourself to actually go as far as you did ?).... 1% / 5%
How much have they paid out so far on ALL claims.... I will assume Zero
I spoke to a guy at B*TT & Co and the guy said that so far they had won their customers tens of thousands of pounds in compensation for it's customers.
I asked how much it had yet got off Jet 2 ...... "NOTHING"
The have already crunched the numbers and done the actuaries, they would have already put a shed load of dosh to one side in preparation of defence of these claims.
One individual claim such as yours, of course it was financially daft, when when you look at the full picture....
If BA pay out every single claim and Jet 2 say end up paying 1 in 20 / 30 / 40 / 100 legitamte claimants (the rest falling by the wayside at each stage of denail)... yet have to pay 10 times the claim value in their defence when it gets to court ! (buttons)
Then they would be quids in.... Dart Group members would be looking at BA / Thomson / Easyjet laughing their a$$es of saying "look at them silly mugs.... paying out !!!!"0 -
They lost another one...
Sooner or later they will probably work out its cheaper to cough up than go to court...
