Consumer Credit Act (Good Old Section 75)
If you paid for your plane ticket with a Credit Card... Would that not make the Credit Comapany jointly liable ?
If you are denied a `legitimate` claim under Regulation (EC) 261/2004 off the Airline.... then could one not make a claim under Section 75 of the Consumer Credit Act off the Credit Provider (as the Credit Provider would be jointly liable)
At least the Credit Ombudsman has more teeth than the CAA.
It's a legal minefield, but legally speaking, does it not stack up ?
Just a thought.

I've just received the 2nd letter from Jet2 stating that my 3 1/4 hour delay was caused by them having to deep clean the aircraft which they class as Extr Circm due to safety shortcomings. According to the cabin crew on the flight the rear of the aircraft had been trashed on a previous overnight flight from Ibiza by drunken passengers but Jet2 are defending this claim by saying that the passengers were ill :rotfl:
I have a couple of questions to take this claim further as I'm determined to make them cough up the compensation.
1. The flight was between Malaga & Manchester so according to the CAA web site this cannot be looked into by them as it was not a flight from the UK :huh:
2. The MCOL website advises that you do not use a PO Box number on the defendant's address but Jet2 use a PO Box for their customer care address. Does anyone know an address for Jet2 without the PO Box number ?0 -
My sister was delayed for 5 hours flying out of leeds 2 years ago. Reason given at the time was damage was caused to plane by baggage handlers removing luggage from inbound flight. She contacted them last November, when flight compensation was in the news, just got fobbed off. After reading some of the material around, could she not use Wallentin? Surely if the plane isn't fit to fly, it needs fixing, and that is therefore a technical problem?0

The thing is Jet2 are fobbing EVERYBODY off so it's no good coming on here asking if we think their reply is genuine.
If you want to take it further you will need to get the details of the flight - time and date and route.
I personally am waiting to see if the caa can get anywhere before going down the court route. Other are diving straight in with small claims proceedings.

Looks like everyone is getting fobbed off by Jet 2
Just received a letter this morning (I was expecting ' extraordinary circumstances') but got the following:
'Your claim, under English Law, must not be greater than 2 years' therefore no compensation'
They have all the fight info necessary (as they requested). The flight was in 2008 and was delayed for ~7 hours
They quote: ' you are claiming under EU reg EC261 / 2004 - but ,ENGLISH LAW, now says (!!) 'has to be less than 2 years' if compensation is to be paid'
Letter on it's way to CAA - but not sure what'll happen next....0 -
