    Hi there - just wondering if anyone can help.

    We were delayed from Lanzarote to Manchester LS892 on 10th January 4.15pm by just over 4 hours. 2 adults and a child. I have completed the letter and sent it off to Jet2 and received a response saying that they have looked in to it and;

    - the cabin crew were unable to make the flight due to a smell on the aircraft leaving them feeling unwell
    - on looking in to the smell on the aircraft they found a minor issue with the plane and so brought another over from Alicante to take us home - hence the delay.

    They therefore say that we are not eligible for compensation as it was beyond their control.

    Where do I go from here?

    On the face of it it sounds like a technical issue which wouldn't be extraordinary.

    Botts are correct, technical issues are claimable. Jet2 know this more than most as Botts won a case at the High Court against Jet2 which now sets a precedent on this issue.

    To say Jet2 are being untruthful would be an understatement.

    I would always trust EUClaim over Bott. The Bott flight checker is essentially useless. Not that EUClaim is infallible but it does suggest the cause of the delay wasn't a straightforward technical issue.

    How contradictory and confusing!

    Firstly you say "technical issue which wouldn't be extraordinary" thus claimable.

    and then you say "I would always trust EUClaim" who say NO, not claimable.

    As Botts cleared up the question of technical issues, for once and for all, in the High Court case Jet2.com v Huzar, there is no doubt at all that technical issues are claimable.

    In their reply to the op Jet2 stated that they "found a minor issue with the plane"

    That is a technical issue, just in case you missed it.

    When the facts are all available and clear, there is no need for you to confuse the issue with your lack of knowledge:mad:

    This, to me, smacks of Jet2’s standard first response of ‘no’.

    In my view, it doesn’t matter if you trust EU Claim more or less than Botts, if Botts are willing to have a go at a case where EU Claim would say ‘NO’ then as it’s all NWNF the OP can’t lose ....

    "Turning to your request for compensation under EC reg 261/2004, while jet2.com endeavours to arrive on time, yo uwill no doubt appreciate that we have occasions where this is not possible.

    On investigation, the aircraft due to operate your flight was unable to do so as scheduled due to medical reasons. Shortly before arrival of the outbound flight in to Arrecife, members of the Flight Crew began to feel unwell. On arrival, and following medical consultation, the crew were declared unfit to operate the inbound flight back to Manchester.

    It was initially suspected that this may have been due to an unfamiliar odour noticed on the flight deck, Any unusual occurence on an aircraft necessitates a mandatory investigation by engineers. On inspection however, no fault could be found and the aircraft was declared serviceable.

    In order to minimise delay, the decision was taken to utilise our Alicante standby aircraft and crew to operate your flight. The standby aircraft was despatched immediately and on arrival in Arrecife your flight departed at the earliest opportunity.

    After careful review we believe the above reason contributes an extraordinary circumstance. We also strongly maintain that all reasonable measures were taken to both prevent the extraordinary circumstances and reduce the delay. etc etc etc Medical grounds confirms that the NEB considers when a passenger or crew member becomes seriously ill or dies on board at short notice before the flight constitutes as an extraordinary circumstance"



    Any opinions now?! What constitutes as a serious illness?! a bad smell?!! Also we were told in the airport there was an issue with the plane nothing to do with the crew?

    Are people on here affiliated with that Bott website? they obviously take a % so just wanted to check if thats worthwhile if its just following up with some further letters?!
