It would be interesting to know if they are already fighting this case...

    Hi PomBear,

They are paying out on LS903, which PCYULJR was on, but not LS904, on which they seem to have made a bit of a stand.

    Good luck

I suppose they are going to maintain weather only. And ignore the fact every other flight landed. And the fact that if they hadn’t been delayed out of Manchester due to the burst tyre, the plains would have arrived before sunset and been able to land on runway 34...

Plains - where on earth did that come from? Just re-read this in shock. I mean planes!

The shame! I would love to plead guilty. It would give me an excuse. And I need one. Sadly, at the time I posted (too early for me, even), all I can blame is an argument with sellotape and wrapping paper... However, if I post tomorrow night, alcohol will most definitely be an excuse...

So, Jet2 have filed their defence.

And guess what, they are putting me to proof that I took the flight!

There isn’t anything that I didn’t expect. They are firmly stating weather. They also say that interest wouldn’t be due on the claim because it isn’t a debt.

Pretty much what I expected really.

Looks like it is going to be heard in Northampton? I requested my local court. Pain for me as I’m oop North and have two young children to care for so childcare will be a nightmare. Not to mention the expense of both childcare and travel.

Is it too late to approach a NWNF firm and see if they are able to take it on at this late stage... Could have done it myself if it was to be heard closer to home, but Northampton is not going to be easy.

It’s probably in Northampton because you didn’t state a required court when you issued your claim. Northampton is default. You will receive a directions questionnaire from the Court and you will have the chance to state your preferred court there. If you are near Liverpool, I would suggest that you choose Liverpool as some of the judges there are specialists in this area.

I definitely requested my local court on the claim form, used the gov.uk website to make sure I got the details right.

However, that’s reassuring that I should get another chance to request my local court. I would like to opt for Liverpool but it’s a bit too far to work round the childcare I can put it place. All very frustrating. That’s why I was wondering if NWNF would be a better option in retrospect?

pombear, I get the feeling that J2 sometimes take a hardnosed apporach to those that are helped on this forum.
I'm not sure a NWNF will help at this stage. Firm your resolve to see this through. J2 want you to crumble in the face of their intimidating and perfidious attitude.

My arguement re. interest is that if the judge finds in your favour it is a debt.
The regulation states that compensation shall be paid, where due. It effectively forms part of the contract between customer and airline.
If the airline fail to pay that compensation, where due, to my mind this has become a debt?
