Hi folks,
Grateful for any advice. I recently submitted a claim to Jet2 regarding a delayed flight in June 2010 from Blackpool to Belfast which arrived over 4 hours late.
I received a response this morning stating the following:
"the aircraft due to operate your flight was delayed due to an airshow at Murcia on the flight date, which prevented the immediately preceding flight from operating as scheduled.
After careful review, we believe the above reason constitutes an extraordinary circumstance."
Should I even bother fighting this? I can see from flightstats.co.uk that they updated the gate time at 1.37am, over 12 hours before the flight was scheduled to depart, which should have been enough time to make alternative arrangements to avoid any delay.
I am aware that I am running out of time so might be worth taking it to Botts but before I do I would be grateful for any advice.

Firstly, knock-on doesn't constitute ECs. And 12 hours should be long enough to work around and provide a replacement plane. They have to prove that they took all reasonable measures to avoid a delay. So I think you have a case but they might not give in without a fight.
If it's an ATC operational decision they will say it's not their fault, but this only counts if it affects the flight directly I believe ("a particular aircraft on a particular day" from memory), and it sounds like this didn't. I'm not that clued up in this area, others will know more
You can check with Bott's flight checker to see if it is eligible for compensation.
But as you are up against time, you need to issue a Notice Before Action and start court proceedings ASAP. Read Vauban's guide about this, you can search for it on the forum. Don't get into exchanging letters with Jet2, they will just try to stall you beyond 6 years.
If you are not confident to go it alone contact a NWNF straight away and they will start the ball rolling in time if they think you have a case.

Just read your post again. It's going to be difficult for them to argue that an air show in Murcia affected a UK internal flight, so I think you have case. It sounds like a simple knock-on. They knew about the show and had plenty of time to avoid the delay.0 -

You have a valid claim. J2 are wasting their time and money again by fighting this case.
J2 are probably just trying it on because you are nearly out of time to claim and that it was an ATC decision at Murcia.
You need to start court proceeding within the 6 year time period allowed so read Vaubans great guide and get things moving.
You could put your flight data into one or two of the flight calculators to get an idea if they think you have a claim. However, Botts usually like to have some time to deal with claims and this may be a bit too close.

Yes this one is quite simple, you have a case howticklediam Edit - and Tyzap are correct, get that NBA in and start court proceedings in 14 days.
You don't have to use a NWNF solicitor, this forum is mainly about helping each other without the use of Solicitors I think you have a very good case, and I'm certain that there is no possibly of this being a genuine EC. Others including myself will guide you through the legal process, but have a read of Vaubans guide, get up to speed and let's get you your due compensation

TBH, I welcome your post, J2, I thought had started to play ball and pay due compensation, I can't see this one getting past the starting post and I'm sure with an NBA it will be sorted, but we're all here - still - to ensure J2 don't start their silliness all over again ....

Hi all,
I recently have been in contact with Jet 2 regarding compensation for my flight which was delayed by over 3 hours on 5th September 2015. The were delayed by about an hour before we were even allowed on the plane and then upon boarding the plane we were told that there was a fault with the door, we then waited just under 2 hours on the plane where the cabin crew and the pilot repeatedly explained that we were delayed due to a fault with the door. The engineer's managed to fix the door and we were on our way. Upon arriving at Dalaman airport we were over 3 hours late.
I initially contacted Jet 2 who got back to me saying that the delay was an extraordinary circumstance and therefore they wouldn't be paying compensation. I replied again stating that we were told the delay was due to a technical fault and as the new ruling states from the previous court case - a techincal fault is not an extraordinary circumstance. I also contacted the Civil Aviation Authority and asked them to look into the case for me.
I received an e-mail back from the CAA who advised that upon looking into my case they have found no extraordinary circumstances for the delay and have advised Jet 2 that they are liable to pay the compensation. Unfortunately as they are not an ombudsman they can't force Jet 2 to pay the compensation claim. I therefore contacted Jet 2 AGAIN and copied in the correspondence from the CAA. I received a letter back from Jet 2 at the weekend again stating that the delay was due to air traffic control restrictions (which is not true) and they would not be paying compensation!!
I know the next step would be a small claims court however i do not want to be out of money for this. I feel angry that Jet 2 are refusing this claim even when the CAA have advised they should be paying out.

In answer to your question, because they can! Plus of course, Jet2 have form for this type of thing, look at the length of this thread....
...BUT.... Only if you let them,
1) Read Vaubans Guide
2) Issue NBA use NWNF if you must, but no need myself and others will hold your hand through the legal process.
3) Enjoy your compensation.
