HI Justice13075, the delay was over seven hours in the end. 7 hours, 8 minutes to be precise. I'm just reading the guide you all suggested just now, many thanks for your help. Fingers crossed I get somewhere.0

One bit of advice DO NOT get in to a ping pong with them meaning read the guide issue a NBA/LBA give them time to reply they will try and fob you off if they try this go straight to court action. Any excuse they give you they will have to prove at court.0

There has been some payouts from Jet2 without the need for Court action, so it's right to give them a chance with the NBA, but chances are you will have to commence proceedings to get your rightful compensation.After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

I was on this same flight (LS406) from Paphos to Leeds Bradford (06.07.2014), I just wondered if you had got anywhere with the compensation claim? Any information would be greatly received.

MattI started this post sat in Paphos airport entertaining myself with filling in the MSE claim template after my Jet2 flight LS406 PFO – LBA 06/07/14 has been substantially delayed. The departure time was supposed to be 09:55 and we were called to gate just after 21:00 only to be told half an hour later that our flight was delayed by 40 minutes and we should sit down. I then made my own enquiries and found that the inbound leg (LS405) had been about an hour late at take off. The boarding queue began to form again and we were told at about 10:30 that there were further delays and we would be updated at 23:00. Rumour had it that there had been difficulties refuelling the aircraft. At 23:05 we were promised an update at 23:30, at 23:50 we were told that a replacement aircraft had been despatched and the flight had been delayed to 06:00 the following day. We were issued with €13.50 each in vouchers and settled in for the night.
At 02:30 we were told that a replacement aircraft would not arrive until the afternoon and that our departure time had been further postponed to 16:30. It was announced that coaches had been arranged to take us to hotels, we were tucked up in bed by 03:30 and told that our included breakfast service ceased at 10:00 and lunch would not be provided. Coaches would come at 13:30 to take us to the airport for the 16:30 departure.
Understandably we chose to skip breakfast and sleep in and in the morning, went out to find our own “brunch”. On returning to the hotel we found that Jet 2 had authorised free lunch!
We were duly bussed back to the airport to find that our 16:30 departure had been delayed and that our boarding passes were not valid and that we had to check in again even though we were travelling hand baggage only. As the coaches arrived the whole flight queued in front of the empty check in desks for the best part of an hour until 3 check in operators arrived. We were handed a letter explaining that a replacement flight was en route from Manchester and our new departure time was given as 15:30, we were issued with further vouchers worth €10 each.
Before boarding it was announced that the plane was carrying no food or drink other than tea and coffee so we would be allowed to take on board food and drink purchased in the airport.
The remainder of the flight was incident free and we arrived at LBA at about 20:00 some 19 hours late! We were told by the flight crew that the rescue flight was carrying the spares required to fix the original aircraft and it is easy to draw the conclusion that the rescue flight had been postponed until the parts could be marshalled.
The MSE claim template is great and I have just worked my way through it, all being well my claim will be in the post soon.
Just 1 thing confuses me. The table quotes a 1500km+ limit of €400 for intra EU flights and €600 for flight into or out of the EU of more than 3500km. However some of the “key in your details to see what you can claim” websites are telling me €600. LBA - PFO is a bit borderline, the point to point websites are telling me that it is 3400km but they calculate on a great circle (shortest distance basis). I think it highly likely that on a "km covered on actual flight path" basis that the distance travelled could actually be greater than 3500km!
I am trying to decide, should I be claiming €600 or only €400. Can anyone advise please?

Judgment set aside by the same judge who made the judgment in the first place. Crazy!
So they are getting their day in court, must be costing them some dosh to defend this. One has to ask what's the point?0 -

Absolutely barmy from start to finish! I'd ask on what grounds they have achieved a set aside, the legal rules should be tight, ie the defendant has a good chance of success of defending the claim, the way the Courts work, they just do what they want anyway........
Don't let them off the hook, they ought to be totally ashamed of themselves, appalling disgraceful behaviour by Jet2 and their legal team....
Good luck with your case, you deserve far more than the claim, for the run around you've had.

I opposed the set aside but I'm not sure it was seen in time, it went in on a Friday, the judgment was dated the following Monday so who knows. For once the court acted quickly, all within a week.
The judge also said he was allowing the Claimant's application to set aside, when it was the Defendant's, so I'm not sure how much attention he was paying.
The way I see it is, if they are prepared to go to these lengths to defend a claim, good luck to them. They've already lost in so many ways.0 -

Normally, he would issue directions at the same time as the set aside?
Sometimes our legal system is laughable, the more I get involved in it, the more you see so many injustices and the inadequacies in it all, what the lay person would never imagine.After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

Not listed yet, "to be re-listed", basically he/she copied the draft order supplied by the defence verbatim.0
