    Jet2 flight delayed. Several letters back and forth.

    Their latest letter is claiming 'extraordinary circumstances' and further adds 'due to a technical issue caused by a third-party'.

    They further mention National Enforcement Bodies (NEBs) benig responsible for enforcing the 261/2004 and 'paragraph 19 (of a letter linked below) ...caused by third-parties...' are classed as 'extraordinary circumstances.

    Note: Cannot post link as I'm a new user, but the link is not working anyway.

    Has anyone got a view on the 'third-party' tactic they are using here?

    AlphaGeek. Have they given you any further details about this? If not, unless you have already sent a formal notice before action, it is worthwhile sending them one further letter (and I mean one) asking them to elaborate and that if they don't or their explanation is inappropriate you will sue them. Then do it.

    Yes, I've had the usual 'letter tennis' with them going by reading this thread.

    The have had an LBA so it's time to issue an N1 I think. I was just wondering if they had used 'third-party' as an excuse successfully in the past (and by 'successfully' I mean in Court, not just fobbing off the less determined claimant!)

    I wrote to Jet2 and they tried to weasel out of it, wrote to the CAA, a few letters went back and forth and it was put on hold. We asked for an update last month and gist of the email from the CAA was that they'd advised Jet2 that they should pay us, but can't enforce it.

    I just last week started looking into taking legal action and the cheques just arrived out of the blue!

    Hopefully we are all wearing them down and they will start coughing up the cash!

    A miracle! Does this mean that Jet2 were actually mistaken when continuously quoting 'extraordinary circumstances' etc.? Surely not!
