  • I had a delay in September, they replied to my initial email with the usual holding letter. I chased last month and received another holding letter. I have heard further today declining my application for compensation due to adverse weather conditions. Whilst it was raining, other airlines were landing and taking off including Jet2. Their third party desk at Prague airport unfortunately for them, and unfortunately for me not in writing, told me that the flight was stranded at Vienna airport due to technical difficulties, so I know the delay wasn’t caused by adverse weather conditions. Is it worthwhile me pursuing this - I would send a notice before action letter and then instruct Bott & Co (?). Any advice will be gratefully received. I accept adverse weather conditions will prevent a plane from being able to land/take off but surely that would prevent all airlines from landing and taking off. In my circumstances it was raining, surely rain is not adverse weather?

    If you're going to instruct Bott, perhaps hand the whole thing over now. Or you could see if a NBA shifts them - but it's unlikely.

    Thank you, and for your quick response. I will do as you suggest. I just wasn't sure due to them citing extreme weather conditions.

    If it was extreme weather then it probably would be extraordinary circumstances. However, jet2 will probably have a list of 5 or 6 excuses for the delay and go through them one at a time as required. The only way they will pay out is by taking them to court.

    Jet2 are unhappy with the 261/2004 regs and think they are unfair to airlines and disproportionate. However Jet2 and the scurrilous practices they and other airlines use are probably one of the main reasons the ECJ brought the rules in in the first place.
  • I could do with an update on the Bradford Jet2 case. Does anyone know anything?

    Has anyone asked Botts what happened?

    How long does it take for a ruling to be published?
