  • Good morning fellow sufferers.


    Slightly unusually Jet2 asked the Harrogate Court to 'stay' my case specifically referring to the Liverpool case (rather than the KLM one).


    I have therefore e-mailed the Court this very morning inviting the learned Judge to rule in my favour.


    I shall keep you posted!

  • Only in the same way as Allen has no bearing on any other case, it becomes highly persuasive. The County Court ruling does not create a precedent that other DJ's HAVE to follow, but hopefully they will.

    The Scottish case is less persuasive then Allen, but still persuasive.

  • I'm thinking of compiling a list of regulations, OFT guidance, law and cases that can be used to fight the two year time-bar defence. I have a small dossier now.

    Or maybe even starting a separate thread as I'm sure there are other airlines trying this one on, not just j2 and RA.

    Apart from the time it will take (but I have to do it at some point for court anyway), I'm a bit wary of giving away too much info in advance of what I might or might not know to the lurkers who work for the airlines. Am I just paranoid or is that a real risk?

    Maybe I should wait for the March case as that might clear it all up anyway.

    Would anybody else find it helpful and want to share and contribute?


    Flybe are also trying to use the 2 year limitation. They amended their T&Cs in 2014 to try and make it tighter by specifically mentioning claims under 261/2004.


    However I have been able to get them to accept a claim submitted over 2 years after delay by highlighting that they have only recently amended T&Cs and providing a copy of the Vergara decision. I am in Scotland so that possibly helped!


    I think a separate thread would be best as there are many people posting about the 2 year limitation.

    Yes, disapearing regular posters, although Blond Mark did post before he vanished that he had been offered a very generous settlement.

    Non of our posts were tampered with but limpit2 removed their post and deleted their profile too.

    @howticklediam, go for it both put a new thread up and gather the info as it effects more than one airline, this was done with the Huzar thread and that's why I started the Allen thread.

    As far as the snoopers, I don't worry about them because it would not help them one bit reading any of my posts :D

    They employ aviation specialists to fight the every delay anyway, so I'd post all the info we have up, for me this is only how we can learn from one another and indeed argue over the regs, we argue them out here, then we each feel confident to argue it all out in Court.

    After observing the Allen case personally I can say that I felt confident that I would be more than a match for our feathered friends. There was nothing new in the Airlines submissions, the really hard part was having to keep my mouth shut throughout the dross from Mr Charles Bear QC.
