  • Hello, stared my claim back in feb 2014 for a flight in aug 2012, got 2 letters saying out if their control, wrote to Spanish caa who said they were, wrote back to jet 2 and they have replied saying its over 2 years and no legal action started so now expired can anyone advise if this is correct and is it worth filing court papers

    Actually their terms and conditions do NOT state LEGAL action within 2 years. You made a claim, to the company, within 2 years, as per their (probably unlawful) T & Cs. Maybe have a chat with Bott.
    You could argue in court that Jet2 deliberately "manoeuvered" you out of time

    In infant settlement case (99% of which relate to accidents) most Courts want the child there. In cases of this nature, where the compensation is fixed by the regulations, it's unlikely that the Judge would insist especially as the ticket was bought by the parent. It is worthwhile asking the Court though (and indeed the airline whether they want the child there.)
    It also depends on how old the child is. A 13 year old might enjoy the fun

    I phoned the court but they can't tell me as it constitutes legal advice so I'm going to have to write to the court to ask the DC. What a palava!

    Personally I wouldn't bother, I would turn up to the court and state that you are your daughters representative and father. A common sense approach has to be taken, if for any reason, I can't think of one, then the DJ could always give further directions to attend a further hearing to enable your daughter to be present.

    Incidentally, this is on the J2 thread, I can't see any cases listed as they were all in limbo pre Allen and I suspect there will be a small delay, before cases are heard as J2 ponder there next move.

    I think you have me confused with someone else. I have four kids and a court date, they tried to stay me wrt VDL but I objected and have a date in Leeds. BB indicated two witnesses in the directions questionnaire so I presume they are not interested in the kids. Two are doing exams so I don't think it reasonable to expect them to attend. But as usual you have to use the belt and braces approach so I'll seek clarification form the DC.

    You are acting as LTF children need not attend, I would obtain a letter from yourself and your missus signed that you are acting as authorised claimant and lead passenger on behalf of all claimants just in case.
    This is what I have done.

    Thanks. I've sorted all the court paperwork and all that side is agreed and it has been allocated with me as LTF and lead claimant so I should guess it will be OK. But as I don't trust anyone I will write to the court to get confirmation, explaining that the kids are in exams etc. so there can be no surprises.
