    My case was also 'stayed' (if that's the term) by the Court to await the Huzar appeal - both 2birds and myself were asked if that was okay and we said Yes.


    I had read the news obviously and Jet2 (and now Thompson) are going to take this all the way probably to the European Court so I kind of assumed the local Court would continue to do nothing.


    Is there anything to be gained by giving them a nudge?

    Wb, and I was wondering what happened to your case, what was the specific wording regarding the original 'stay' I suspect it was 'stayed' pending the outcome of the CoA decision, so your claim has effectively become active and a quick letter to the Court Manager, asking them to refer your case back to a DJ for directions should suffice, J2 will also write to the CC, asking for the 'stay' to remain in place, I know that's what's happened to my case, so it will be down to a DJ to issue directions, please don't give up, fight against the stay, catch up on the Huzar and J2 thread and you'll be back up to speed in no time.

    The feeling on here is that the law should be interpreted by the CC's as the ruling by the CoA is basically final. It will be for J2 to convice the Courts otherwise.

    We finally got a refund which took 6 weeks and we did pay by credit card. We also wrote directly to Jet2 who, as "a gesture of good will" have given us 2 free extra leg room seats for our new return flight!!! WOW I'm only 5'2" .......

    If you mean Mr huzar has been paid then yes he has, he confirmed that a week or so back. His family have not. Now if you mean have they been paid out yet then could you post the link.

    Airlines at the moment are in a concerted effort to force the courts to stay the cases pending again without knowing if they have been allowed permission from the SC. If this is the case then this is not Justice and we should cry out load about it.

    we were delayed on jet2 flights from murcia to manchester then from manchester to murcia- Friday, 08 May 2009 returned Monday, 11 May 2009. we were delayed approx 4.30 hours both journeys. after hearing about delays compensation i have written to jet2 detailing delays with all delay info. just received letter saying as the claim is over 2 years old i do not have a claim.i dont think this is correct any advice on what to do next.

    If that is what they have said, they are lying, which is frankly disgraceful. Have a look at the thread "Flight Delay Compensation Important Info - Please check before posting"

    I started this post sat in Paphos airport entertaining myself with filling in the MSE claim template after my Jet2 flight LS406 PFO – LBA 06/07/14 has been substantially delayed. The departure time was supposed to be 09:55 and we were called to gate just after 21:00 only to be told half an hour later that our flight was delayed by 40 minutes and we should sit down. I then made my own enquiries and found that the inbound leg (LS405) had been about an hour late at take off. The boarding queue began to form again and we were told at about 10:30 that there were further delays and we would be updated at 23:00. Rumour had it that there had been difficulties refuelling the aircraft. At 23:05 we were promised an update at 23:30, at 23:50 we were told that a replacement aircraft had been despatched and the flight had been delayed to 06:00 the following day. We were issued with €13.50 each in vouchers and settled in for the night.

    At 02:30 we were told that a replacement aircraft would not arrive until the afternoon and that our departure time had been further postponed to 16:30. It was announced that coaches had been arranged to take us to hotels, we were tucked up in bed by 03:30 and told that our included breakfast service ceased at 10:00 and lunch would not be provided. Coaches would come at 13:30 to take us to the airport for the 16:30 departure.

    Understandably we chose to skip breakfast and sleep in and in the morning, went out to find our own “brunch”. On returning to the hotel we found that Jet 2 had authorised free lunch!

    We were duly bussed back to the airport to find that our 16:30 departure had been delayed and that our boarding passes were not valid and that we had to check in again even though we were travelling hand baggage only. As the coaches arrived the whole flight queued in front of the empty check in desks for the best part of an hour until 3 check in operators arrived. We were handed a letter explaining that a replacement flight was en route from Manchester and our new departure time was given as 15:30, we were issued with further vouchers worth €10 each.

    Before boarding it was announced that the plane was carrying no food or drink other than tea and coffee so we would be allowed to take on board food and drink purchased in the airport.

    The remainder of the flight was incident free and we arrived at LBA at about 20:00 some 19 hours late! We were told by the flight crew that the rescue flight was carrying the spares required to fix the original aircraft and it is easy to draw the conclusion that the rescue flight had been postponed until the parts could be marshalled.

    The MSE claim template is great and I have just worked my way through it, all being well my claim will be in the post soon.

    Just 1 thing confuses me. The table quotes a 1500km+ limit of €400 for intra EU flights and €600 for flight into or out of the EU of more than 3500km. However some of the “key in your details to see what you can claim” websites are telling me €600. LBA - PFO is a bit borderline, the point to point websites are telling me that it is 3400km but they calculate on a great circle (shortest distance basis). I think it highly likely that on a "km covered on actual flight path" basis that the distance travelled could actually be greater than 3500km!

    I am trying to decide, should I be claiming €600 or only €400. Can anyone advise please?

    Article 7.4 of the Regulation says explicitly: "The distances given ... shall be measured by the great circle route method".
