  • I understood that Ryanair would only accept the small claims process through Irish courts.  I think this might have changed since 2015 - there's a discussion about it further back in the thread.  The costs involved have actually turned out to be quite a bit cheaper through the Irish system too and it was easy to do - although I probably would've opted for UK if I'd know/ if it was an option.

    When my husband asked for a voucher, Ryanair did not agree to this.

    The flights did operate but Ryanair's terms and conditions stated that they would offer a refund on medical grounds.  We've asked them a couple of times to explain why our request was rejected on medical grounds, but they haven't replied.

    We have annual travel insurance.  This was renewed after we had booked our flights, but just as the Coronavirus pandemic was beginning to impact travel - so the travel insurance for the year covering the trip excluded the pandemic sadly.  We have logged to discuss a possible claim with them - but that was several weeks ago and  we're still waiting to hear back.

    On the Ryanair website it also says that you can claim back government taxes on flights not taken - even if they did not cancel them.  Unfortunately the Ryanair form for this does not work on the website - I've sent in a general query about this pointing it out, but just get a generic replay back via email stating what forms to fill in for what purpose.

    We aren't holding out much hope for success, but we're determined to try.  Its a lot of money for them to hold onto, when we really had no option to fly!

    APD is £13, Ryanair fee for processing APD refund is £17....

    The European Small Claims Procedure is an EU wide scheme which allows someone to take a small claim (up to €5000 I think) against a person or company in another EU country but actioned in that persons own country. For example - Ryanair left us stranded at Málaga Airport so I took a case through the courts in Sheffield, I won and then, when Ryanair refused to accept the UK court ruling I brought a case for payment via the Dublin Sheriffs Office (like the UK Baliff) and they "retrieved" the monies + costs from the Dublin office of Ryanair.  Although the cost of doing so will vary from one country to another if you win then you are awarded all costs.
    Although the UK has left the EU as of 31 Jan 2020 we are in the Transition/"Implementation Period so all EU legislation still applies. UK Government website shows this Procedure is still in operation https://www.legislation.gov.uk/eur/2007/861/chapter/iii/2020-01-31
    Hope this helps you and for others - Ryanair can be beaten!

    Nothing wrong with all the above and yes the ESCP is still a valid process to use if necessary to beat RA. 
    Reason why you may have to submit claims to the Dublin courts was a sneaky inclusion some time ago to RA's T's and C's that stated that no claim would be considered by them unless brought within the Irish Courts. Typical RA, all designed to make the 'person in the street' go away. It can still be done, depending on RA's terms at your time of booking this may have to be your route. But it is still the same ESCP route as if you were claiming from Sheffield for example. I did write some notes on this some time ago, search the thread for my posts and you should still find.

    Nice to see the good Dr back.
    So to clarify, I can still use ESCP, through my local English court to retrieve debt from RA?
    I have a potential large claim against Ryanair for 3 cancelled flights from March and June which have still not been refunded, despite numerous reminders.

  • Hi JP,  I trust you are well. 
    Regarding ESCP, Yes you should be able to, just check their T's and C's at your time of booking to see if the wording 'only claims brought via the Irish Courts' is written in there one way or another. If so use the Dublin County Court to process your claim(s). It's still ESCP, just negotiating RA'S terms.
