I know but the compensation is due under an EU ruling. So I am just surmising that we might not be entitled to claim under it after Brexit...
One thing has nothing to do with the other. Your entitlement to compensation in this case has nothing at all to do with whether or not the UK is in the EU.0 -
They might not and if they do, they will need to produce new evidence in order to change the decision of AviationADR. Simply saying "we disagree with the ruling" isn't going to cut it.
after a few messages in the past 7-10 days
I finally got my update today
RESULT (well almost) ADR found in my favour
Ryanair tried to blame the wind
however ADR accepted the fact they never did enough to get us to Manchester as the plane left there empty
although they are not paying up for my pre paid hotel
just paying out the standard 250 euros x 2
next stage will be how long it takes to get paid out

Hello, I have a query is anyone can help.
I was due to fly from Manchester to Ibiza with a friend on the 12th of September 2017.
On the 11th of September I was notified that this flight was cancelled. I then had to book an alternative flight.
However, I do not have any details other than the airports, the time of the flight and my name.
Unfortunately my friend booked the flights through his e-mail and had all the details, and sadly has since passed away.
I only recently learned that I could claim compensation for this. I did message Ryanair and they responded within hours but stated that I did not give them enough details.
Do I have any chance of compensation without further details?

The golden rule is "he who asserts must prove". Unless you can provide some evidence that you were booked on the cancelled flight and as to the cost of your alternative flights, you will be in difficulty. If it was a UK airline I would recommend sending them a SAR (subject access request) but I don't know if the same rule applies in Ireland and what steps you could take if the airline ignores it. Others have more experience of the SAF procedure than I, but my gut feeling is that you are in difficulties0

FWIW, EUClaim says the cancellation was due to extraordinary circumstances so you might not be entitled to compensation even if you did have all the relevant details.0 -
Just to clarify, you're entitled to a refund after 5 hours under EU261 but not rerouting.
It says this on Ryan Airs own site
'If your flight has been delayed more than 2 hours, there are two options available for you to choose from. You can either apply for a refund or change your delayed flight for free within the Ryanair network.'
So clearly she should have been able to change flight, but they refused multiple times to change it..Keeping her there until they cancelled it 12 hours or so later..
I take it from what you have said that being able to change after 2 hours is Ryan Airs policy and not a statutory right then..I presume they have an obligation to follow their own advertised policies?

So, we got the following response from Ryan Air
'We regret the delay of your flight, which was caused due to fire at the airport.
As this delay was unexpected, no compensation is due under EU261/2004 as this was caused due to circumstances beyond Ryanair's control.
Thats it, literally completely ignored the fact they refused to allow us to to change the flight, offered no accomodation to a mother alone with a baby etc..completely ignored all the screenshots of conversation I sent them.
The key bit regards money being, if they had allowed change of flight whilst they were available which they should have done, we wouldnt have to have spent another £200 to get back, no answer as to why they refused to change the flight after aprox 8 hours of delays to an ultimately cancelled flight..
Whats the next step?, I am going to take them to the small claims court, but I presume I should give them a second chance to address the points raised which they have ignored thus far...?0 -
If you have sent all the supporting information and arguements to Ryanair already, there is probably no point contacting the again. As Ryanair have withdrawn from ADR, ESCP is your only option (unless flight departed from UK in which case you can refer to CAA...)
