My last AviationADR claim took 6 months and 8 days to complete. This is from the day I filed a claim until the day I received the preliminary ruling from AviationADR (the party it goes against has a chance to object, if they do it will add further time to get a final ruling). Every time action was required on my part I responded within a couple of days. AviationADR, on the other hand, missed pretty much every one of their own deadlines.

    in my complaint file
under Final Decision it states (in Favour of Consumer)

just wish someone would update me one way or the other

Yes, Its my understanding that initially compensation wouldnt be due, its more the fact they themselves refused to allow us to change flight which we were fully allowed to do after 5 hours delay, and the subsequent need to pay £200 to get home the next day with another airline..

I suspect you are right they won't willingly do anything honorable..I am willing to take them to the small claims court.

I wonder if they are waiting for the airline to respond? As I mentioned above, the party the ruling goes against will have a chance to object.

Just to clarify, you're entitled to a refund after 5 hours under EU261 but not rerouting.

besides being Ryanair and being as obstructing as possible

I don't see how they can object to the decision

our flight was cancelled, yet it was diverted to Manchester (from Liverpool) and then took off several hours later (empty) to its original destination, what Ryanair failed to do was transfer us all to Manchester to link up with the flight

As an aside, its interesting that ADR allow a response to their decision.
    CEDR don't.

They might not and if they do, they will need to produce new evidence in order to change the decision of AviationADR. Simply saying "we disagree with the ruling" isn't going to cut it.

I submitted a claim to ADR on 30 July 2018. You may remember Ryanair staff were striking last July. As a result, my husband was delayed for hours with our 6 and 2 year olds in Gdansk airport. Ryanair refused my claim for 'security reasons'. When I escalated through ADR, they claimed a bird strike but did not provide any of the relevant paperwork. On 8 January, the adjudicator provisionally found in our favour with 14 days for us to respond. I responded straight away but received a notification on 15 Feb to say that Ryanair had (surprise surprise) objected. Now at 27 March, I still haven't heard anything further. I wonder if Ryanair are delaying in the hope that, after Brexit, they won't have to pay it, since it is an EU ruling?!

It has nothing to do with Brexit. For one thing, Ryanair is an Irish airline.

I know but the compensation is due under an EU ruling. So I am just surmising that we might not be entitled to claim under it after Brexit...
