    IMO, it is still valid as per the reasons that Boatman posted earlier. I think that Botts are getting tied up by it because of their regulatory status in England and Wales only.
    So if needed, try it in your nearest UK court.

    Now, I always like to have a Plan B.
    Should this odious restriction be applicable to the Litigant in person, we play a different way.
    Remember this restriction is designed to make you go away, not bother with taking the case to court because it has to be heard in an Irish court.
    No problem.
    We still use ESCP, we choose the Irish court of our choice that is up to speed with ESCP claims. Do your homework, check first.
    Then we register the claim at that court, ( try and pick one most convenient/ cost/ time effective for you to travel to, you'll see why in a bit).
    State on your form 'A' that you are using this court as it is in the domicile country of the defendant. That's RA's T's and C's met.
    State on the form you do not request a personal hearing, it's your right to do this.So you shouldn't have to go to court for an hearing, a real plus of the ESCP for most litigants.
    So from here, the claim should progress using ESCP as if it were being used in a Sheffield court, or Paris or Berlin. In another words if I order Big Mac n fries in either city I get the same wherever, it's the same here, a process with the same end result.
    Now, be aware, the judge does have the right to call a personal hearing, I've seen this before and attended a few of these over here in the UK.
    When you file your claim, within your additional information state that you are only pursuing this in whatever Irish court because of the restrictive terms of RA's contract when booking.
    Normally you would be sensible and file the claim in your country of domicile.
    So, a personal hearing is expressly not requested to limit any further costs both to yourself and the defendant.
    This may work in your favour and ensure no personal hearing is required. But, include an estimate of your reasonable costs to attend court, flight, taxi etc and include this in your additional information, and that you expect to claim this back if you win.
    If you do have to go, then claim back your reasonable costs when you win.

    Remember ESCP, is a process, it is still valid and works in the Irish Court System.
    RA want you to go away and this is just another twist in their terms to encourage you to do this.
    I'm sure Botts will be working on an appeal, and have an excellent track record in this field. After all RA claims are business to them.

    There is a really interesting article on BBC Radio 4’s You and Yours programme re Ryan Air and their excessive cancellations.

    Worth a listen - should be available on BBC Radio iPlayer soon.

    Apparently BBC Look East are running the story in more detail tonight too, which will be available on iPlayer for those of us in other regions.

    I'd like to look at this for last weekend to see if Ryanair disproportionately cancelled flights in comparison to others...

    Yep - you can use FlightStats to get the departure and arrival boards. This was how I made my case against Jet2. They claimed adverse weather. I traced every flight due to land over a four hour period - no others had been diverted or delayed.

    But, it cost me a whopping $24.99 for one month’s subscription. I paid it because I had to make my case water tight. Interestingly, we were due to go to court. Their solicitor signed for my bundle 1pm on a Friday - first time they saw my evidence. I received an email from them on the Monday at 8.30am offering settlement in full plus my court costs.

    I believe if you only need departure / arrival boards within the last three days or so, it’s possible to get that info from other tracking sites at less cost.

    it was today’s episode of You and Yours (3rd August) at 12.15pm, although as Tyzap has time stamped, the actual piece on Ryan Air was in the last 10 minutes of the programme.

    How far does it go back, I may need Stansted Jan 2015? Mine sounds similar, a 4 hour delay thats been blamed on weather, the trouble being that other flights were leaving on time or a bit late. Worth remembering to take pics of the departure board in future.
